One more thing. This often goes unmentioned in discourse with those who only see a power-hungry Executive, but a President’s first priority is almost always preserving the power of the Executive Branch. We are not a parliamentary nation. We have a Chief Executive and his powers as outlined in our constitution are significant. Congress tries to grab power too and sometimes they try take power that doesn’t belong to them from the Executive branch. I would examine context and the ebb and flow of checks and balances and of the politics of the specific situation before coming to a conclusion whether Bush broke the law or not. Using Executive Privilege or ‘Singularity’ was more than likely a response to a legislative power grab by Democrats. I would bet money on it.
