Dane County judge orders Capitol reopened to public

A Dane County judge this morning issued a temporary restraining order requiring the Capitol to be reopened.

The building was under tight security this morning with public access limited.

The order from Judge Daniel Moeser requires the Capitol to be open during business hours and "at times when governmental matters, such as hearings, listening sessions and court arguments are being conducted."

The AFL-CIO, AFSCME and other unions sued after the Walker administration began restricting access to the Capitol.

Moeser's order notes it is in effect until a hearing can be scheduled on the matter.

UPDATE: 11:17 a.m. -- The Department of Justice, which is representing DOA in the matter, said there will be a 2:15 p.m. hearing before Dane County Judge John Albert.

Agree, however isn’t a capacity limit in the Wisconsin Capitol?
The video and pics I have seen have all shown a very big crowd. I believe the Fire Marshall should exert some leadership and limit the crowd to a legal, manageable size.

Judging by some of the people I've seen on TV, no showers, bare feet, etc. I'm guessing the building stinks to high heaven and needs a good scrubbing.

They should be able to protest during NORMAL BUSINESS HOURS only. Building should be vacated and locked at closing time. If they wish to come back the next day so be it.

I wonder if anyone has asked the question about what the maximum occupancy, per fire code, is allowable in this Capitol building? Just curious. Seems there has to be a number somewhere.

"Under those procedures, protestors will be allowed into the building, but crowd size will be adjusted to accommodate the cleaning crews, the preparation for the Tuesday’s joint legislative session and the number of protestors who remained in the building overnight."

You won't get any argument from me. FWIW, I think allowing these loons to run amok is the mother-of-all security risks to my mind. Who the heck knows who these people are and what they're bringing into the building, or what they do while they're in there.

Even more it would be like Obama forcing the Capital to open its doors to 5 thousand screaming Islamic jihadists whose only intent was to intimidate congressmen and disrupt the activities of congress.

I agree. The state capitol is not a hotel. The homeless are routinely escorted away after building hours. I do not believe that groups can have organized protests either. You need a permit for an organized protest. The protests can be held outside. Drums and other disruptive devices should be banned with individuals removed.

The Wisconsin House needs to pass a resolution censuring the Democrats who participated in the “get in your face tactics.” The disgusting outburst was incredibly disrespecting to the hallowed legislative room.

If the Govenor can ‘close’ the Capitol; then the Legislator can pass bills without public knowledge - this is the path to tyranny.

This is a safety issue. A limited number of people can be allowed if they do not disrupt the duties of the government or pose a threat to safety by making loud noises, impeding access, or harassing others.
