The Legislature's lawyers have told Republicans that Democrats could put taxes on the ballot with a majority vote under narrow circumstances.
The opinion, sought by Senate Republican Leader Bob Dutton, does not specifically address Gov. Jerry Brown's proposal to extend higher income, sales and vehicle taxes for five years at a June election to help solve a $26.6 billion deficit.
The Democratic governor and majority Democratic lawmakers say the only sound way to place the taxes on the ballot is through a two-thirds supermajority, which requires at least two GOP votes in each house.
Republicans saw the legislative counsel's opinion as proof that Democrats can solve the budget situation on their own if they wish, taxes and all.
"If it stands up legally, it shows Democrats could put tax hikes on the ballot without Republican votes," said Dutton spokeswoman Jann Taber. "If they're courting us for votes, they're looking for political cover."

Great Video cilp...frankly Kalifornia serves as a great example of what Wisconsin is trying to turn into. State/Public employee unions are killing the ‘Golden State’.
Unions were never needed at this level anyways except to award such a generous screwing of the taxpayer. No point trying to talk to the rank and file worker, just kill the damn union and get it over with.
CA PUBs should hide out in AZ until the state is officially bankrupt.

The public has voted taxes down twice.
Maybe they’ll get a clue this time.
They do if they want to blame the GOP for the resultant crash.
I do like the California Republicans. They won’t see power again for generations...if ever, but they stand on principal and fight (at least in this case, for this bunch). Let’s wish them the best.
Kalifornia was issuing IOU's a couple of years ago for tax refunds and payments to creditors. Banks won't take the IOU's because they know the state doesn't have the money owed. Sounds to me like they're already bankrupt and just won't admit it......
The funny thing is, the California GOP would return to relevancy immediately if California public union money was banned from politics.
If Californians would just pass Paycheck Protection laws, or make California a Right to Work state, the Democrats river of money would dry up over night.
A few weeks back there was a story some group was looking at crafting an initiative to do something along those lines. I haven't heard anything yet but it's something I'm keen attempting even if the moronic majority fail to pass it.
It'll be hard as hell to pass based on the gov't unions ability to cobble together $100,000,000 in a given election cycle to push their agenda.
It is always an uphill battle against union-funded campaigns. Chicken and egg, here. To get rid of union money flooding politics, you have to get politicians banning union money. I don’t see how we do that except that as California sinks deeper into financial morass, and as the mild depression goes on and on, more impacted California voters may wake up to the need and quit supporting the government unions.
This is another way of saying that both parties want the tax proposal on the ballot.
