Hatch bill to eliminate visa lottery, establish exit procedure

Later this week, Sen. Orrin Hatch (R-Utah) will introduce the Strengthening Our Commitment to Legal Immigration and America's Security Act that would eliminate the Visa Lottery, strengthen interior enforcement, and require the implementation of an exit procedure for foreign visitors to the United States.

Sen. Hatch unveiled the details of his bill on Friday while addressing the Heritage Foundation in Washington.

"I continue to believe that we must do everything to properly and finally secure our border," Sen. Hatch said. "Many of our nation’s problems result from a residual effect of a porous border and a breakdown of our immigration enforcement system...."

Sen. Hatch's legislation would have six major points:

* Prohibits the Justice Department and Department of Homeland Security from issuing a mass amnesty to illegal aliens through the use of deferred action. Deportation cases could only be deferred after being considered on a case-by-case basis.

 * Requires municipalities participating in Secure Communities or 287(g) to fully comply with federal immigration enforcement agents.

* Requires the Department of Homeland Security to create a mandatory exit procedure for all foreign visitors to the United States.

* Eliminates the Visa Lottery that issues 50,000 greencards regardless of the individual's educational or economic attainment. Requires the Department of Health and Human Services to draft a document every year detailing the dollar amount of federal welfare benefits received by illegal alien households in each state and the District of Columbia.

* Allows states to continue receiving federal matching dollars for covering legal immigrant children and legal immigrant pregnant women, but only after the state has provided the federal government with evidence that at least 90% of its eligible U.S. citizen children and pregnant women have been covered by either CHIP or Medicaid.

* Requires the IRS to notify employers when there is a mismatch between an individual and a social security number, and if the employer does not act within 60 days, requires the IRS to notify the Social Security number holder.

* Allows authorities to charge individuals who have used stolen identities, who are also being charged with another felony, to be charged with aggravated identity theft.

"I hope now you can see why I believe the fight to control the border is no longer isolated to just the physical boundary between the United States and Mexico," Sen. Hatch said. "My bill represents solutions to key immigration issues confronting our great country. They are common-sense solutions designed to strengthen our commitment to legal immigration and America’s security."..

I would forgive him all of his previous BS if he is successful in getting rid of the visa lottery, the so-called "diversity" lottery that brings thousands of parasites into our county each year, established by the now-defunct Senator Splash.

First glance, sounds like a good bill.

Not sure about the following:

Needs to also put a clamp on muslims being able to bring anyone who claims to be a family member over. But maybe this needs to be a separate bill.

The sound you hear is that of Orrin Hatch sweating bullets after seeing his long-time colleague Bennett tossed in the caucuses last election cycle. I would ask the good Senator, how do you plan to pay for this? And knowing that there appear to be aspects that are either unworkable or unconstitutional, doesn’t this really just represent an effort to appeal to a politically active and organized element of the Utah electorate?

That would necessarily apply to ALL FOREIGN VISITORS ~ those with visas and those without visitors.

The great advantage of that is that EVERYBODY who gets caught due to a Visa Overstay, revolution back home, illegal entry or whatever, will be TREATED IDENTICALLY by ICE, and by the COURTS.

We can even create a legal determination that ALL CHILLUNS' BORN here to any alien visitor are subject to the visa standards pertaining to diplomats ~ and work from there. They'll all get to be sent home ~ and no more dual citizenship.

How about adding #7 to: “charge the Medicaid and Welfare costs of illegals to their home country and either offsetting these costs against any foreign aid supplied or simple confiscating the equivalent in resources”?

This is already on the books, but never implemented and enforced.

"A new technology program that records the entry and exit of nonimmigrant visa holders visiting the United States went into effect earlier this month at many U.S. ports of entry. The United States Visitor and Immigrant Status Indicator Technology (US VISIT) program is designed to track the amount of time nonimmigrant visa holders spend in the United States and to alert the government of those who remain beyond the expiration of their authorized stay.

"According to the U.S. Department of Homeland Security, the goal of US VISIT is to track the millions of people who come to the United States every year on business, student and tourist visas - and to use the information as a tool against terrorists.

"As of Jan. 5, 2004, the entry process of US VISIT is in effect at most major U.S. points of entry, but the exit process has only been implemented at one airport and one seaport. The system will continue to be implemented at various airports, seaports and land crossings over the next two years and is required by law to be operational at all ports of entry by Dec. 31, 2005."

Ending the visa lottery means all the Somalis keep coming in on humanitarian visas,,,, but the hot educated russian women will get excluded.

And then this is posted on the State Department's consular website, in which they give up entirely despite the existing law:

Effective May 6, 2007, international travelers are no longer required to check out at a US-VISIT exit kiosk.... International travelers who received a CBP Form I-94 (Arrival Departure Record) upon arrival must still return it to an airline or ship representative when departing the United States.

That's only part of the picture ~ we have people here without visas who need to be treated the same as OVERSTAYS.

The parole deal also needs some serious revision ~ LIKE elimination!
