Thanks for posting the entire article. Keep it up.
This is gonna get very interesting. Looks like a constitutional crisis to me.
bttt
Don’t forget, plus an overwhelming majority of the Florida people as well!!!
The American People are asserting their power-can you hear us now Obama/Pelosi/Reid?
.
***** Still, Zirkelbach emphasized that throughout the health care debate, the insurance industry has argued that the individual mandate was *********
INDUSTRY??
Pam Bondi for Vice President.
No, it's not. It's the federal law that was struck down. States can do or not do as they please, without reference to this decision.
This is one of the times we admit, with pride, we are from Florida!
“This is one of the times we admit, with pride, we are from Florida!”
Yes, and we have lots to be proud about. We did great in 2010 sending some DEMS home. Now we must vote out six more DEMS from the US House and Bill Nelson from the Senate! It can be done with feet on the ground helping to spread the word! :)
I wish it was. But, without the injunction, Vinson can't force them to comply.
As someone else pointed out on another thread, another district judge is citing the Obama administration for contempt of court for violating his injunction against the moratorium on offshore drilling.
This criminal administration won't even comply with an injunction. Do you really think they will "honor" a declaratory judgment?
Unfortunately, the first thing that someone must do is get Vinson to issue an injunction. There's no legal penalty for ignoring a declaratory judgment.
But, Vinson can't issue an injunction for those other states. Jurisdictional rules require that the plaintiff reside or otherwise be connected to his district (the Northern District of Florida).
And the plaintiff has to show injury to achieve standing. If the Obama administration simply avoids Florida, or the Northern district of Florida, they may be able to avoid the "Wrath of Vinson".
