Durbin to chair hearing on health care

U.S. Sen. Dick Durbin will be chairing a congressional hearing Wednesday on the constitutionality of last year's health care reform bill, an event that will likely challenge Monday's latest ruling by a federal Florida judge the law is unconstitutional.

Durbin, D-Springfield, a staunch supporter of the reform, said two judges have upheld the law and two found that Congress over-reached its boundaries in mandating people buy health insurance by 2014 or face penalties. Legal challenges, which have been brought up in 26 states, are driven by partisan opposition to the reform, Durbin added.

The latest judicial ruling also comes two weeks after House Republicans passed a bill to repeal the health care law. Similar efforts in the Senate aren't expected to pass.

Wednesday's hearing will be before the full Judiciary Committee. Sen. Chuck Grassley, R-Iowa, will be the panel's ranking mem-ber.

Fellow Sen. Mark Kirk, R-Highland Park, said Florida followed Virginia - the other state to rule against the law - because "Congress cannot force Americans to buy what they may not want."

"This year, I will work to repeal and replace this law with better reforms like medical malpractice reform and protections for your right to buy health insurance from any state in the union," Kirk added.

U.S. Rep. John Shimkus, R-Collinsville, who recently voted to repeal the bill, indicated the case against the reform is growing. Shimkus has urged Gov. Pat Quinn to challenge the law, but so far the Quinn administration has given no indication they intend to do so.

"Individuals' rights and freedoms must be protected," Shimkus said. "If eventually overturned, we should proceed with respon-sible health care reform that contains insurance reform that lowers cost, improves access, and maintains the doctor-patient rela-tionships."

A request for comment from U.S. Rep. Jerry Costello, D-Belleville, was not returned by a spokesman by deadline Monday. Costello has maintained his support for the reform, saying it is better to fix what needs to be fixed rather than repeal it altogether.

Maybe they should've done this before Commiecare™ was even voted on. A day late and a dollar short.

Civility.

Remember "deemed to have passed" over in the House - I think it was called the Slaughter rule. EVERYONE WITH A THINKING BRAIN KNOWS THE RATS JAMMED THIS DOWN THE COLLECTIVE AMERICAN THROATS WHEN IT WAS NOT WANTED. Now they want to figure out if it is Constitutional? What a bunch of morons up there in the District of Corruption.

Durbin to chair hearing on health care constitutionality

Next, the United States Court of Appeals, Ninth Circuit, will hold hearings to draft new legislation to govern national medical insurance regulation…

“What we passed in Congress is Constitutional because we say so. You don’t need to ask the courts.”

He puts new meaning in “schmuck.”

It was a ragged, ram-cram job. They left way too many loose ends.

Reminds me of the game “Risk”- they rolled the dice too many times trying to conquer and take us out.

They didn’t quite, and now they are spread too thin. Easy pickin’s, boys. Attack on all fronts!

I hate to tell Sen. Durbin, but there is nothing he can say or do regarding Obamacare. It’s been ruled to be unconstitutional by a Federal Court. The administration can appeal, but for now Obamacare is DEAD.

And the dims in the Senate know that SCOTUS will eventually agree with Judge Vinson. Durbin’s panel is all about seeking cover. Nothing more.

Durban does not have the power to chair a meeting on anything. Only the majority party chairs meeting. He can have a get together and chew the fat, and that is all, does not mean a thing. He may have barney over for some closet action however.

Senator Dickie - not Congressman. The Dims still hold the Senate.

Does Turbin really believe he can declare the federal court decision null and void?

Does he have any idea that there are two other equal branches of the federal government?

As much as I think this, theoretically, is a good idea: “and protections for your right to buy health insurance from any state in the union, Kirk added” would it not drop health insurance right on the front porch of the (mis-read interpretation of) the Commerce Clause, thus allowing the fedgov to “manage”it?

Question for Durbin's star witness:

"Sir, are the terms "interstate" and "intrastate" synonymous? Interchangeable? And if Congress has the right to regulate interstate commerce, does it therefore have the right to regulate intrastate commerce?"

A day late and a dollar short.

Pretty much describes that commie Durbin the Turban. He personifies everything evil and disgusting with Illinois and demoncrap politics. The guy who demonized all our troops with his references to Nazis etc. I am praying for the day his sorry A$$ is booted out of the Senate, but then he lives in Illinois so he should have a secure sinecure from that god-forsaken state.

Political Science 103: Legislative Process
Instructor: Dickie Durbin

In this class, Professor Durbin will lay out the Democratic understanding of the legislative process, in which,

firstly, votes are taken,
secondly, the bill is then written
and thirdly, hearings are held.

Yeah, and they were so intent on ramming it down people’s throats they forgot the severability clause.

I wonder how Nancy feels today? Obama probably doesn’t feel too well. I would have loved to see his reaction when the news broke LOL.

Well, like Queen Nancy said earlier, “We have to pass it to see what’s in it!”

Looks like they found out at least what is NOT in it........

Yeah, and they were so intent on ramming it down people’s throats they forgot the severability clause.

Actually I have heard they took that clause OUT.

Severability Clause Removed From Obamacare before it became law

Lack of severability clause could doom ObamaCare in high court

Too Good To Check: ObamaCare’s Missing Severability Clause
