Appeals court rules SF not repsonsible for deaths

San Francisco cannot be held responsible for the deaths of a father and two sons allegedly gunned down in 2008 by a man city officials refused to report to immigration authorities, the state Court of Appeals decided Monday.

The ruling upholds a February 2010 Superior Court decision.

Tony Bologna, 48, and his two sons, Michael, 20, and Matthew, 16, were shot to death in a car near their Excelsior district home in June 2008. A third son in the car was not injured.

Relatives sued the city, claiming San Francisco's sanctuary policy protecting illegal immigrants kept the alleged gunman, Edwin Ramos, in the country and played a major role in the slayings.

Yet both the lower court and the appellate court agreed that the city isn't legally to blame for any crimes Ramos committed following his earlier arrests as a juvenile for assault and attempted purse-snatching.

The family of the victims argued that the city violated federal law in not reporting Ramos, who was 21 at the time of the killings, to immigration officials and therefore failed to prevent the crime. Laws protecting cities from such liability prevailed in the case.

This state is unlivable. California is not healthy for children and other living things....

For once I agree with a court. The real culprit here is the U.S. Government. They are responsible for keeping these murdering, illegal maggots out of the country. Sue the feds.

It’s the same court that tries pretty hard to keep you from defending yourself. At least under federal law (as it is currently applied, i.e. irrespective of the Constitution) you can own and carry a whole bunch of guns. But not in SF.

I disagree and agree.
The Feds are the main culprit, however Sanctuary City San Francisco is also culpable. Their mayor (Formerly Gay Mayor Gavin Newsome - now Lt. Governor Gavin Newsome) refused to allow Feds to deport illegal aliens, and their D.A. (Formerly City D.A. Harris, now State Attorney General Harris) refused to prosecute the illegal invaders.

So a father and son got killed by one of these human maggots - and the City is not at fault...right.

If justice is no longer available through the court system, innocent victims needing to be made whole will have to resort to other means. A recipe for anarchy and vigilantism. An appalling vista.

Insane Francisco. They deliberately created the policy which allowed the criminal to stay in the country, setting the wheels in motion, how can they NOT be responsible??

This should go to the US Supreme Court! These sanctuary cities need their feet held to the fire, for once.

Not having read the decision I may be wrong but it probably has to do with the long standing principle of Sovereign Immunity and not siding with the state against the common folk.
