Firm fights immigrants' suit: Baird Tree denies discriminating against Hispanics

A Caryville tree-trimming company is confessing it may have employed illegal immigrants, albeit unwittingly, in a bid to defeat a labor lawsuit by Hispanic workers.

Baird Tree Company Inc., which contracts with KUB to provide tree-trimming services, is facing a lawsuit filed in U.S. District Court by 21 Hispanic laborers who allege the firm shorted them overtime pay.

In response to the lawsuit, Baird is now contending the firm has since learned some of the suing workers may be illegal immigrants and, if so, should be barred from suing.

'The defendants believe that some of the plaintiffs are illegal residents and lack proper immigration status and … may have falsified certain immigration employment application documents to obtain employment with the Baird Tree Company Inc.,' attorney David H. Dunaway wrote.

Days after the lawsuit was first filed in late July, the firm fired the workers but rehired them when their attorney, Arthur F. Knight III, responded with an injunction request, court records allege.

But in the months since, Knight and fellow attorney Patrick Looper contend the firm has continued to retaliate by reducing the workers' hours and changing their job sites. When the workers alleged the firm had offered them $5,000 each to drop the lawsuit at a meeting Dec. 1 and threatened further retaliation if they didn't take the offer, Knight and Looper filed another injunction request.

Most businesses hire illegal aliens while making minimal effort to check that they are authorized to work. Well, I wonder how diligent this employer was in checking papers; did they use e-Verify etc.

Not to worry----the ABA will gut any annoying US law that interferes with illegals' plans to populate the US and arm themselves for Reconquista (/snix).

REFERENCE The "American" Bar Association's new president, Stephen N. Zack, announces a new direction for US law. Zack intends to hold public hearings across the country to “study” whether the US legal system is “addressing the needs of Hispanics.”

The ABA is no longer concerned with “US law.” They Are Peddling Race Instead of Law. The ABA is poised to segregate Americans into classes each with their own “laws.” According to the ABA, we now have “Hispanic law,” “African American law,” "Sharia Law," “Gay Law”………… maybe a little “White law” thrown in here and there. Maybe “non-human law” is next? In case your dog might want to sue someone. And, of course----imposing Sharia Law on Americans.

The reason for “Hispanic law”? Because Stephen N. Zack, the new president of the ABA, is a Cuban-lawyer from Miami. Can you say conflict of interest?
