Youtube video. Russell Pearce, Arizona State Senator is introducing a new immigration bill
in Arizona, to stop granting citizenship to those born within the United States, to foreigner parents.
Section 1 of the 14th Amendment states, "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of
citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws."
There have been at least two Supreme Court decisions which clearly state that the phrase "subject to the jurisdiction thereof" was intended to mean entirely or completely subject to the jurisdiction of the United States and to no other nation, and that this phrase was originally intended to prevent the children of foreigners from obtaining citizenship by simply being born within the United States. Natural born citizens are those that are born within the United States, to US citizen parents.
Your citizenship rights follow those of your parents.
If simply being born in the U.S.A. means one is eligible to be President of this nation, then there are a Hell’uva lot of anchor babies that would qualify.

Zero's lost a lot of support, and the bad economy is making Americans even more aware that illegals are sucking the life out of our nation. It's going to be harder for Holder to go after Arizona again.

Case laws conflicts on this issue. It’s true that there are cases which contend that citizenship belongs to only babies born to parents of US Citizens, but in recent decades, Federal Courts have ALSO FOUND that children of illegal aliens or one is from a foreign country and the other is a US citizen are ALSO due to be recognized as citizens of the US.
This is ABSOLUTELY legislation that MUST be revisited, and clarified. The Courts have muddied the waters and the politicians have avoided the issue long enough. That’s created most of the ridiculous “birther” issues we get with the Obama presidency.
It’s TIME for this debate, for this law, and for this fight. Set forth the principle, and make it CLEAR from this point onward, that THIS will be what we understand to be a US CITIZEN in the 14th Amendment, based on THESE Historic and Legal precedents.....
And I hope “Birthers” will be able to live with the potential conclusions. And if it disqualifies a future “Obama,” oh well, too bad so sad.
It would be better to spend the time writing laws that affect access to public assistance, schooling, housing, etc. Another effort could be a reattack on the portions of SB 1070 that were struck down by the courts.
An effort against anchor babies isn't going to work until there is a federal law written which stands up to SCOTUS scrutiny against the current interpretation of the 14th amendment.
Yeah? Try telling that to the US Congress. They've written thousands of illegal laws, AND they're enforcing them on the people.
There's just always one damn reason or another why a sovereign state can't fight back, or do what's in the best interests of its own citizens. This is exactly why there's a Tea Party, and it's also the reason that this crap is going to go where no one wants it to, if the suppress isn't taken off our backs!
I'm nearly seething as I write this. To HELL with the freaking suppressive jackboots! The azzholes in Washington will do NOTHING to stop the invasion coming over our southern border, but WE WILL, if we have to have a WAR to freaking do it!

Let me tell you something. I’ve lost nearly everything I owned over the last five years due to illegal labor driving down the cost of professional services in the construction trades. I’ve spent my entire career honing my skills in this business. I’ve become an expert in what I do, but today, I can barely make enough to keep my family off of welfare.
My business (what a laugh) is nearly non-existent today. Five years ago, my family was living an above average middle class lifestyle. I employed highly skilled workers to work for me. I created JOBS, and I earned a good living. I worked my hiney off to achieve all that, and it all crumbled because ILLEGALS destroyed it.
This isn’t some abstract political discussion for me. My family is literally in POVERTY because of this situation, and I am LIVID about it!

And many other “legal” laws that are not enforced - like the immigration laws.

People like you remind me why we must fight for enforcement of existing immigration law and make new ones which greatly increase the penalties for hiring illegal aliens. A few employers (restaurant owners, lawn care company owners, construction contractors) need to go to jail to send a message that it is not OK to hire illegal aliens.

That is the problem, the original interpretation of the 14th was children born to parents who owe allegiance (subject to ) to the U.S. were born citizens.
Would the Supreme support the original intent or create a new one to be politically correct?
Arizona would not be in violation of the 14th if it was enforced as originally wrote.
so we’ll just ignore existing laws like the feds do, the idea is to make the state inhospitable to illegal aliens so they go elsewhere. If they think AZ won’t grant their spawn citizenship then maybe they’ll go whelp them in CA. Win for AZ loss for CA, but CA seems to want them.

We all want the same thing, illegals out of the U.S. The question is how you do it. Passing laws with an almost zero chance of standing up in court is not an effective way of doing it. SB 1070 was a much better effort than passing a state law attempting to define national citizenship. It would be a better use of time to find work arounds for the court failures on 1070 to improve its effectiveness. If Arizona wants to go to court it should start suing for the cost of housing illegals while waiting for the feds to deport them.
