Supreme Court Justice Sonia Sotomayor has set herself apart from colleagues with her fervent statements protesting the majority's refusal to take some appeals, particularly involving prisoners.
Each month, the justices spurn hundreds of petitions from people who have lost in lower courts, and rarely does an individual justice go public with concern about the denial. In the seven times it has happened since the annual term opened in October, Justice Sotomayor has signed four of the opinions, more than any other justice. She was the lead author on three, again more than any other justice.
She forcefully dissented when the justices refused to hear the appeal of a (Sotomayor protests court's refusal of appeals) prisoner who claimed he was punished for not taking his HIV medication. He said prison officials subjected him to hard labor in 100-degree heat. Writing alone, she said the inmate had a persuasive claim of cruel and unusual punishment.
This emerging pattern of dissenting statements helps define a justice in her second term who is still like newest justice (Elena Kagan) fresh in the public eye.
What is environmental justice? It inherently seems to me like a contradiction of terms. Since environments are subject to physical and social change, in flux every day, how can you find justice?
She is a problem. With all of the brilliant and highly accomplished Hispanic members of the bar, Obama could have picked a true asset to the court. He went for the ideology and nobody with half a brain could possibly believe any of that ideology. So.. we have a justice with less than half a brain. Our Founders knew what they were doing when they made the Court a plurality...

That was precisely the reaction I had upon reading the summary. What is different about this one, aside from her inexperience and incomptence, is her consumate skill in NOT answering direct questions --- sort of like Charlie Rangell --- and impatient about changing character of our country through judicial activism. She figures the legislature will back her up. Except for one thing.
Overeaching is always the demise of the pathological controller with god-complexes. The Great Uniter is a good example, as well as the leadership in the current House.
Overeach and pay the consequences; likely being shunned by the majority of the justices forever. Many of us thought she does not have the competence skills and experience to do the job, and her gauche behavior simply confirms her total lack of judgement and of the plain elementary rudiments of social ettiquette. Newbies to any new group simply do NOT try to take over the conversation before a discreet period of pretending that they are social animals --- not neurotic trailer-trash teenagers in adult bodies.

It is inteesting to note that most "minority" groups, aka groups with a tendency to separate themselves from the society in which they find themselves, develop into three groups. A small percentage actually adapt and compete successfully in the common culture, another larger percentage adopt the criminal behavior of their original culture (these tend to produce the activists and hard core criminals) and the majority which simple become invisible with neither special skills or interests.
Unfortunately, political activists tend to drift int the legal profession, where a veneer of competence makes them specially dangerous. These are the destructive ones.
Of the truly competent group, the educated and wise ones are never candidates for judgeships or nominated for congress or the presidency.

Screw the criminal defendents’ perspectives, if they’re guilty. It they actually innocent, that’s different. But I’m sure all of these (or 99%) are just protesting legalisms.

I replied to #1 who said she is an activist. I would add that she has neither much concern regarding the welfare of this country nor respect for the Constitution.
