Another judge may reject health care overhaul

Could President Obama's health care overhaul be struck down by a second federal judge?
That's a distinct possibility. Roger Vinson, a federal district court judge in Florida, said yesterday it would take "a giant leap" to accept the Obama administration's argument that requiring almost all Americans to buy health care is constitutional, reports the New York Times.
"People have always exercised the freedom to choose whether to buy or not buy a commercial product," Vinson added.
His comments came in a hearing for a lawsuit brought by a coalition of 20 state attorneys general, all but one Republican.

Vinson's comments in court yesterday suggested he could go even further than Hudson in siding with the law's challengers. The health care law contains numerous parts, and Hudson stopped short of ruling that if the individual mandate is found unconstitutional, the law's other provisions -- expanded access to Medicaid, for instance -- would also have to be thrown out. But Vinson suggested he disagrees, comparing the law to a watch, with interlocking components.
Ominously for the law's supporters, Vinson noted that the law also had "been compared to a Rube Goldberg invention."

Fearless prediction time: Vinson will declare the entirety of Obamacare unconstitutional. His ruling will be upheld on appeal. The Supreme Court will allow the lower court rulings to stand.

What would stop them from just creating a government insurance fund (like social security) for health care?
simply offer health insurance coverage program for anything you want covered, at $2K a year for a family plan
the other insurers would be out of business in 2 years, tops
Which raises the question how can government-run retirement annuities be both mandatory and constitutional yet government-run mandatory healthcare is not.
I'm thinking the constitutionality of mandatory government-run healthcare will eventually be upheld. Social security won't be overturned on constitutional grounds at this point.
i am concerned that his announcing that he will rule as unconstitutional. he may be looking for something from the obama administration as a pay for play move. I may be wrong but does a judge announce in advance how he will rule.

I believe that the 1 AG which is not Republican is Cortez-Masto, in Nevada.
She didn’t want to join this lawsuit, but the outgoing Governor- Jim Gibbons ORDERED her to do so.
Lets hope another decision declaring ObamaCare unconstitutional will give the GOP Congress some backbone to totally defund ObamaCare.
Since it seems quite likely the US Supreme Court will concur and declare ObamaCare unconstitutional, it would be senseless to spend money to implement something that is going to be scrapped.
