Taking the lead where Washington has wavered, California on Thursday is expected to adopt the nation's most ambitious plan yet to curb global warming.
The California Air Resources Board is all but certain to vote to approve comprehensive "cap and trade" regulations designed to cut greenhouse gases. The regulations would impose limits, or "caps," on emissions from large industrial polluters through permits, or allowances, that could be traded on a market.
California's plans to forge ahead are in sharp contrast to the lack of action from Washington, where Congress has rejected cap and trade at the national level. While the state's plans have drawn criticism from affected industries, the cap-and-trade program is expected to be a boon for Silicon Valley's burgeoning cleantech economy.
"We are the innovators when it comes to figuring out how to reduce carbon," said Bob Hines, energy director of the Silicon Valley Leadership Group. "We're really excited. It sends the market signal we've all been waiting for, and it's going to lead to further job creation."
Kate Gordon, vice president of Energy Policy for the Center for American Progress, a progressive think tank called the regulations "a game-changer. We have an existing infrastructure for fossil fuels, and this levels the playing field for cleantech."

Under the new system, which goes into effect Jan. 1, 2012, California would distribute annual allowances to such industrial entities as power plants, oil refineries and cement and glass factories that emit large volumes of greenhouse gases. In 2015, the program would extend to distributors of transportation fuels.

And yet we here in CA had the opportunity to half-a$$ repeal this crap and tax bill just this past November and it failed. I have lived here most of my life and love the area. I’ve also posted in the past in defending CA and not wanting to leave like others have when the going got tough. This bill and the fact that CA Dems gained in CA in November leaves me and the family no other choice. CA is lost.

It seems to me it is extortion. The state does not collect a tax, but mandates that fees be paid to third parties. The scramble for this money will be obscene.
Not to worry. The current exodus out of California is packed with fed-up conservatives and tax paying business people. They're the ones who are being forced out. The Gimme Class will stay put until the well runs dry.
I'm one of those tax paying business people who was run off. I left Cali for Texas five years ago, and never looked back. Broke my heart, too, because it's my home state.
I hope that some day, the good people of that state can somehow turn it around. I'd still like to own a piece of ground there in my old age.
Sadly, the people will have to sue to protect their competitive interests. This will, of course, make California manufactured goods less competitive than goods made in other states. I wonder if it can be halted on the commerce clause, that the state is stepping on bounds reserved for Congress. It would be one time the commerce clause should be put to use. Also I wonder if the state is creating a currency, and also providing unequal protections. If you are in business now you get credits to trade and seek but if you decide to start a business later, you have to buy credits from others to open your doors. That is an unfair advantage and anti competitive. I wonder how many ways this can be attacked. It needs to be stopped.

Very prescient of you to write that patent. Normally I oppose business process patents that automate existing business methods, but if you will put yours up to stop AQMD then I can support that much.
I wrote it while writing my first book because I feared that somebody else would do it. I felt that monopoly power to control markets in the use of environmental assets is simply too much power, particularly in the hands of the government. I wanted to see a competitive system develop. Monopoly price fixing is a monstrously corrupting process. The provisional application was 18 months in front of Bartels' Fannie Mae application.
Frankly, I do not have the time or money to pursue an infringement action against anyone right now. Nor am I interested in extorting anybody for a license fee while they go on to raid the public. I put up these posts in a sense because I want to see some good come of it. The thing cost me three grand in legal fees that came to nothing over a period of eight years. I went pro se, wrote the claim, and had the allowance in months.
Anyway, that's the story.

Heavy-handed, draconian government regulations are put in place to destroy industry and Bob Hines says this is “the market signal we’ve all been waiting for.” Liberals are insane when they confuse regulatory authority with “the market.” There is no other word for Bob than “stupid.”
