The 35-year-old Long Beach man killed in an officer-involved shooting Sunday was holding a pistol-grip water nozzle, not a gun, Long Beach police officials said Monday.
Two officers responded to a 911 call at 4:40 p.m. Sunday from a neighbor reporting an intoxicated man holding a "six-shooter" in the 5300 block of East Ocean Boulevard in the upscale Belmont Shore neighborhood.
"The officers had a position of cover and were observing the suspect while other officers were en route," said Sgt. Dina Zapalski, a spokeswoman for the Long Beach Police Department.
Zapalski said Douglas Zerby had been sitting on a stoop playing with what appeared to be a weapon and pointing it at objects as if it were a gun. He extended his arms and pointed in the direction of an officer. Police said they did not have time to make their presence known or to tell Zerby to drop the weapon before opening fire because they believed he was a threat.

Nope. No diversion here. The truth is probably somewhere in between what was reported and what really transpired. I never believe what I read or hear with the exception being if I actually see it for myself.
But so you know, this does not make it OK for the LEOs to stand behind cover, with shotguns, opening up and killing this guy, without first shouting, "Police, drop the gun".

I agree...The LEO’s had cover, shotguns in hand...A quick, “Police, drop the gun” would have saved a hell of a lot misery and senseless tragedy.
Considering they had NO LEGAL RIGHT to Sneak into neighboring yards in an effort to attempt to prevent a Man from committing an act or offense THAT IS LEGAL AND NOT A VIOLATION OF ANY LAW. IT IS COLD BLOODED MURDER by COWARDS. I am still waiting for the Boot Licker trolls here to explain to us all WHAT WOULD HE BE CHARGED WITH IF HE HAD A GUN AND WASN’T KILLED?? That’s what I thought, NOTHING. Which Means that from the instant they stepped out of their patrol car IT WAS Excessive Force and a Clear Violation of Law. FIRST DEGREE MURDER IS THE ONLY CHARGES AVAILABLE under these circumstances, withs a Special Circumstance allegation of LYING IN WAIT. GIVE THEM THE NEEDLE.

It appears obvious that you cannot fully grasp the facts surrounding this Cold Blooded Execution by COWARDS. So here goes:
WHAT LAW WERE THEY ATTEMPTING TO ENFORCE?
WHAT LAW WAS HE SUSPECTED OF VIOLATING?
Anything short of answering these 2 questions is just drivel.
Do I expect that to happen in this case? No. But I do expect them to be commentated and promoted.
Cops should be trained and held accountable for their training.
They effed-up big time. Shooting an unarmed man without warning is a crime and they should be prosecuted.
Hiding behind the badge and the “I was amped up and thought it was a gun” is a bull$hit excuse. Once we accept that then there is fundamentally no accountability for a cop's judgment or actions.
I hate it when they do that. Don’t they realize how long it takes for them to mature? But then, what of the nasturtiums?
I say that because I’ve read so many stories of how the first thing they do is shoot the family dog.
As well they should for electing city officials who do nothing to rein in this type of behavior by the city's police department.
The police were obviously trying to enforce the law which states that for anything you do, even watering plants [as per EPA rules], you are first required to obtain a Governmental Permission Slip. So, he was obviously guilty of ACTION WITHOUT A PERMIT.
In addition to violating the above, the deceased was also violating the regulation which demands that when a police officer enters the immediate area, with 'immediate area' defined as whatever the officer feels like at that time, the normal citizens [otherwise known as peons] are to genuflect with appropriate awe and/or terror at the officer's mere presence. So, obviously, he was guilty of FAILURE TO RECOGNIZE HIS BETTERS.
