Could be more benign: 4th circuit decides case, and the supremes decide that ruling should stand, especially if there is a chance the supremes might be tied, given a recusal.

The issue is too important to follow any sort of rules of decorum or ethics.
Actually, I AM surprised by this. I presumed they would simply ignore the ruling as they have done regarding the off-shore drilling moratorium.
