That’s right; and those in the know have been predicting for weeks that Lakin was going to contest the “missing movement” charge on the grounds that he was not ordered to be on a specific flight — other “missing movement” cases have been beaten with that kind of argument.

But that doesn’t mean that he can contest the charge on birther grounds. In his Care inquiry he stated several times that his orders were lawful, and it’s hard to believe he could simultaneously invoke an eligibility defense on the remaining charge.

We’ll know for sure in the next couple of hours.

Yeah. I am just grasping at straws.

It makes me sick to my stomach knowing that LTC Lakin is going to be punished for doing the right thing.

I was hoping that there would be some positive resolution out of his case.

That hope is nigh on too dim to see now.

Lind won’t let him even bring up the Constitutional grounds. Lakin’s appeal would have to be over the breach of his due process and Sixth Amendment rights.
