Army birther pleads guilty to 1 of 2 charges

An Army doctor who disobeyed orders to deploy to Afghanistan because he questions Barack Obama's eligibility to be president has pleaded guilty to 1 of 2 charges against him.

At a court-martial proceeding Tuesday in Maryland, Lt. Col. Terrence Lakin of Greeley, Colo., pleaded guilty to not meeting with a superior when ordered to do so and not showing up at Fort Campbell in Kentucky where he was supposed to report.

So, in other words, you’re making an assertion based on no evidence.


The evidence that has thus far been persuasive in legal briefs submitted in Obama eligibility lawsuits are that the Governor, Attorney General, Director of Health and Director of Vital Statistics of the state of Hawaii have all confirmed that Obama was born there. The Governor, Attorney General and Director of Health are all members of the “loyal opposition” political party to Obama.
The Director of Health went so far as to declare Obama “a natural born citizen.”

Two contemporaneous birth notices for Obama appeared in local Honolulu newspapers for the week following Obama’s birth. Kapi’olani Medical Center has claimed Obama as being born there in that hospital’s 100 anniversary magazine and Dr. Rodney T. West has been named as Obama’s delivery doctor by one of Dr. West’s good friends. Dr. West died a few years ago.

Thus far, judges have trusted the above evidence as being good enough to establish place of birth.
Finally, thus far no one has been able to produce any credible evidence that Obama was born anywhere else.

Today at his Court-Martial, Army LTC Terry Lakin pled guilty to four specifications of refusing to obey lawful orders, one of which was then dismissed as duplicative. In so doing, he stood before Judge Lind and over and over told her that he was wrong to have disobeyed his orders, which were lawful.

He then pled not guilty to the most severe charge against him, missing the movement of US Air Flight 1123 on 12 April 2010. His sole defense to that charge will be that he was never ordered to board that flight, but instead that his orders required him to report to Ft. Campbell, KY and did not specify the means of transportation.

But it wouldn’t be anywhere near sufficient to get you a security clearance from the US government.

Nope. The Sanity Squad doesn’t participate in “group think.” We have differences of opinion lots of times. But we’re able to disagree politely without launching personal attacks.

Would it be reasonable for me to hold you responsible for every dumb thing some of the more fringe birthers blather on about? Nope.

I think he plead guilty because the judge denied him the chance to make his case heard in court.

That having been said Article 66 of the UCMJ calls for an automatic appeal in any case in which the approved sentence extends to death, confinement for one year or more, or dismissal, dishonorable or bad conduct discharge (BCD) of a service member.

So despite assertions by the so called sanity squad that LtCol Lakin has lost all rights to an appeal by pleading guilty, he gets one anyway.

To be honest, I am not sure what the Sanity Squad is... When I have classes going, I don’t have as much time to pay attention to the boards. Instead of 16 week normal courses, I take the 8 week condensed classes and start a new one every 4 weeks... so I get a little distracted from FR... But I really DO have a 4.0 GPS hehe. I just LOVE having that! I really do!

Members do not waive their rights to appeal when entering an unconditional guilty plea, but they do waive their right to appeal some> issues. In fact, just like in a finding of guilt by a jury panel or MJ, the appeal will be automatic. But, (and I'm speaking generally) with such a plea, what is reviewable by the appellate court becomes limited, which is why such appeals can be expedited - what is reviewable in a plea of guilty relative to a finding of guilty is much more narrow.

It is likely that to have preserved for appeal Lind's ruling (a pre-trial ruling) with respect to the disallowing of the affirmative defense on the Art. 92 specifications, Lakin would have had to have pleaded "not-guilty". He didn't. As such, it's unlikely he can appeal that particular ruling. He can appeal other rulings made subsequent to his naked plea - like sentencing and the like.

Three factoids from today’s proceedings: (1) the order to report that LtC. Lakin has pleaded guilty to ignoring came from the Brigade Commander at Walter Reed Medical Center, Colonel Roberts. Colonel Roberts is one of two winners of the Medal Of Honor in the active duty military.

Roberts' resume is irrelevant. Hopefully the court won't be discussing that.

(2) The prosecution has on its witness list for sentencing, the wife of the doctor who took Lt.C. Lakin’s place in Afghanistan.

Definitely an irrelevant witness. We've been told repeatedly that Lakin WASN'T ordered to deploy to Afghanistan, so there would not be a doctor who took his place, much less his wife. If the prosecutor is admitting that Lakin WAS being deployed to Afghanistan, then they are admitting that Obama's authority over that deployment is indeed relevant. Lakin then has a legal right to challenge that authority.

(3) Colonel Lakin requested and took his pre-deployment leave AFTER he refused deployment.

Again, the official charges do not say anything about Lakin refusing deployment. This is more irrelevant detail.

His superior officers were commissioned under Bush and their commissions have the full force and effect of law (Title 10, specifically) until they receive a new commission or separate from the military.

So if I understand you correctly, President George W. Bush is still our Commander-in-Chief, or does it goes way back to the 41/Bush???
