House May Block Food Safety Bill Over Senate Error(That Dang Constitution)

A food safety bill that has burned up precious days of the Senates lame-duck session appears headed back to the chamber because Democrats violated a constitutional provision requiring that tax provisions originate in the House.
By pre-empting the Houses tax-writing authority, Senate Democrats appear to have touched off a power struggle with members of their own party in the House. The Senate passed the bill Tuesday, sending it to the House, but House Democrats are expected to use a procedure known as blue slipping to block the bill, according to House and Senate GOP aides.
The debacle could prove to be a major embarrassment for Senate Democrats, who sought Tuesday to make the relatively unknown bill a major political issue by sending out numerous news releases trumpeting its passage.

HCR was passed as a “shell bill” in which the house version which was passed by the senate had nothing at all to do with health care. Its original launguage was completly replaced by the senate’s version as an amendment. Even worse, the house version of HCR sent to the senate was never voted on at all.

The bill should have originated with the House. Thats means its dead. I thought this as well--but I read someplace that the House version was passed last year. I hope it has to go again in front of the new House and suffers a defeat.

What Obama has been doing to get around this requirement (that tax bills originate in the House) is to get Pelosi to pass the Senate tax bills like Obama-care as-is. I have also seen Reid take DOA bills passed by the House, gut them and amend them with the new tax provisions. That way they technically originate in the House. In this case the House Democrats are really upset with the Senate Democrats for letting so many of Pelosi’s great bills die, like Cap and tax and are showing it.
The constitution is irrelevant to elected officials, beyond using the term as a political weapon to attack the other party. They sometimes worry what the courts will do, but that is it. Each minority party accuses the other but then ignores it when in power.
There is a conventional wisdom supported by the MSM that the party that gets things passed wins no matter how they do it. But we saw with Obama-care that this was NOT true, the bribes in the bill help make it poison.
