Catholic nurse can't sue hospital that forced her to assist abortion: court

Today the Second Circuit Court of Appeals ruled that a Catholic nurse who was forced by a New York hospital to participate in an abortion does not have the right to sue her employer.

Administrators at Mt. Sinai Hospital had threatened Catherine DeCarlo with disciplinary measures in May 2009 if she did not honor a last-minute summons to assist in a scheduled late-term abortion. The hospital insisted on her participation in the procedure on the grounds that it was an “emergency.”

Lawyers for DeCarlo, however, have pointed out that the procedure was not classified by the hospital as an emergency, and the patient was apparently not in crisis at the time of the surgery.

DeCarlo claims that her participation in the abortion led to serious emotional trauma. She also claims that hospital administrators later attempted to coerce her into signing an agreement to participate in abortions in the future.

The hospital had reportedly known of the Catholic nurse’s religious objections to abortion since 2004.

Alliance Defence Fund (ADF) attorneys had filed two suits in the case – one federal, filed in July 2009, and another state, filed earlier this year. The federal suit claimed that Mt. Sinai ignored federal laws prohibiting coercion while receiving hundred of millions of dollars in federal funding.

In January the case was dismissed by the United States District Court for the Eastern District of New York, at which point it was appealed to the Second Circuit....

Why should we even put up with them? They are killing infants! How does it get any worse than this?

They cower before the Muslims so why can’t we make them cower before us? Conservatives are far too soft.

it was no threat to her career. Nurse’s can get a job easier than any other profession. She made a choice...now she can live with it...

I had to make a choice, but not about abortion, I was assigned to ICU. With no proper training in all the equipment that is used, I refused and the director of nurses for the afternoon shift told me it was no different than any other floor. After I got done laughing, I suggested she pull a nurse from the step down unit outside of the ICU or someone from telemetry and I would be glad to fill that spot...If I was to be sent anytime to ICU you better be prepared to give me a 3 day inservice on all equipment including those used RCU...(Resp. critical care unit. I was sent to telemetry with I was familiar with...Just like those nurses in L & D will not pull from other floors, they will call in one of their own if they are short staffed...If I had been told to go there or go home, it would have been home...patients in the ICU deserve nurses that don't have to think about how a new machine works...

I'm appalled at Mt. Sinai. They have Shabbat Elevator for Jews who observe the Sabbath, but will not allow this woman to refuse ot participate in a medically unnecessary procedure? The irony here is that the abortion described also circumvents Jewish Law.

Reality is that is the case as I described. You can question that all you want, deny it all you want. Yes she should have walked away, but the issue here is larger than just her decision. Its how the system has turned into ignoring the moral and ethical right thing to do. We have people and government officials higher up who push this down the line and it gets institutionalized. You play the game in the courts and more and more those who would do the right thing don't get any protections and thus they start to protect their livelihoods at the expense of others. Of course the the lefties know that this will happen and the outcome is what they want. It is devious and insidious. Because so few can see the bigger picture, this kind of policy continues unabated and we keep loosing our country.

The lives of both must be saved (or it must be attempted); they cannot choose. An Italian woman was recently beatified for bringing a child to term knowing that it could take her life (due to another medical condition), which it did.

While that is certainly the correct position, bear in mind that people like Hillary wanted participation in abortion procedures to be a mandatory part of medical school education. This is where the slippery slope of “She could have quit” has led us. While not supporting her decision in any way, understand that the forces at work against this woman would have every doctor partake in murder before getting licensed; this would give you a left-wing medical field filled with the likes of Dr. Mengele, in which EVERY one of them had already violated their Hippocratic oath (and probably condemned their souls to Hell).

Her life was threatened...her very livelihood (career) was put into jeopardy. Not sure why you are having a hard time understanding the power coercion can have upon people. Empathy (love) is the answer to all the questions. The decision obviously bothered this lady horribly, hence the lawsuit. She was put into a position that caused her to suffer and continues to cause her to suffer.

The main point of the article that is relevant to our lives is that the government can force us to kill others without regard to whether it is morally right or not. Taking your stance on this issue, are you willing to sacrifice your future to fight this evil (government)? I don’t think so.

I have come to the conclusion that I really do not have any interest in sharing a nation with leftists. I view them as being under evil’s influence. Once one realizes the fact that we are not a unified people and looks at the lefts actions through a clear lense we see that they have felt this way for some time now. The problem with the leftists is they will not give up part of the geography, they will force us to leave or become subjugated to their will. They will in no way allow us to be free. Hence, there is no way we can reasonably share our government, nation, culture with them.

I understand the power it can have. I also understand that if you succumb to it you have no moral standing to sue on the basis of your belief. What guidance would you take from the Bible about it? That source is totally relevant here because she is basing her suit on that understanding.
