They just want to stay in business. THe insidiouus effect of the Death Care bill is that many Republican supporting companes will have to apply for waivers, comverting them to the dem cause. Thats how fascism works.

We should be making a huge public stink about it!!!

We need to boycott the government for even doing this. Companies will take what the government gives them.

Get off your anti-corporate high horse.

What this affair reveals is:

1. It's an admission that even the feds recognize that the actual application of Obamacare isn't practical -- or even feasible.

2. If you're big enough to have legal/lobby representation in Washington -- or otherwise know how the system works -- you can get a waiver. Note that some of employee counts were quite small.

It's not some kind of plot against small business. Anybody can get relief, evidently, but you have to know how to navigate the system. That's not a reflection on big business -- it's a statement about the perversity of big government.

It’ll take a good bit of research to figure out ALL the places you might want to boycott. For instance, #26 on the list, “Darden Restaurants” (with 34,000 enrollees), is a conglomerate which owns the following ‘casual dining’ restaurant chains:

Red Lobster
Olive Garden
Longhorn Steakhouse
The Capital Grille
Bahama Breeze

I agree with you. But we should be making a stink about this. This is how liberal fascism works, ingratiating those who wish to stay in business.

It makes free people run to Big Brother for help, instead of establishing free competition. The favored get to survive.Gradually monopo;ies are established.

By the way, the 1,175,411 “Total” enrollees noted at the bottom of the list does not include the enrollees from a company called ‘Reliance Standard’ (a health insurance group of some kind), which lists its number of enrollees as “varies”.

The actual number of ‘enrollees’ affected by the exemptions is probably significantly more than 1,175,411.

Approved Applications for Waiver of the Annual Limits Requirements of the PHS Act Section 2711 as of November 1, 2010

*All Applicants Listed have had 1 or more plans/policies approved

Applications for waivers from annual limit requirements are reviewed on a case by case basis by Department officials who look at a series of factors including whether or not a premium increase is large or if a significant number of enrollees would lose access to their current plan because the coverage would not be offered in the absence of a waiver. More detailed information on specific criteria can be found at: http://www.hhs.gov/ociio/regulations/11-05-2010annual_limits_waiver_bulletin.pdf. Approved applicants are granted an annual limit waiver for one year. Won’t all these waivers make Obamacare a bill of attainder?

It would seem to fit with the original intent or our founders... this is illegal!

Bill of Attainder

Definition: A legislative act that singles out an individual or group for punishment without a trial.

The Constitution of the United States, Article I, Section 9, paragraph 3 provides that: "No Bill of Attainder or ex post facto Law will be passed."

"The Bill of Attainder Clause was intended not as a narrow, technical (and therefore soon to be outmoded) prohibition, but rather as an implementation of the separation of powers, a general safeguard against legislative exercise of the judicial function or more simply - trial by legislature." U.S. v. Brown, 381 U.S. 437, 440 (1965).

"These clauses of the Constitution are not of the broad, general nature of the Due Process Clause, but refer to rather precise legal terms which had a meaning under English law at the time the Constitution was adopted. A bill of attainder was a legislative act that singled out one or more persons and imposed punishment on them, without benefit of trial. Such actions were regarded as odious by the framers of the Constitution because it was the traditional role of a court, judging an individual case, to impose punishment." William H. Rehnquist, The Supreme Court, page 166.

"Bills of attainder, ex post facto laws, and laws impairing the obligations of contracts, are contrary to the first principles of the social compact, and to every principle of sound legislation. ... The sober people of America are weary of the fluctuating policy which has directed the public councils. They have seen with regret and indignation that sudden changes and legislative interferences, in cases affecting personal rights, become jobs in the hands of enterprising and influential speculators, and snares to the more-industrious and less-informed part of the community." James Madison, Federalist Number 44, 1788.

Supreme Court cases construing the Bill of Attainder clause include:

Ex Parte Garland, 4 Wallace 333 (1866).

Cummings v. Missouri, 4 Wallace 277 (1866).

U.S. v. Brown, 381 U.S. 437 (1965).

Nixon v. Administrator of General Services, 433 U.S.425 (1977).

Selective Service Administration v. Minnesota PIRG, 468 U.S. 841 (1984).

I copied the list into a spread sheet and sorted it by number of enrollees.

The six ‘Applicants’ with the largest number of ‘enrollees’ (not including Reliant Standard with their ‘varying’ number of enrollees) are:

UFT Welfare Fund = 351,000
CIGNA = 265,000
Aetna = 209,423
BCS Insurance = 115,000
Darden Restaurants = 34,000
Local 25 SEIU = 31,000

In a sane world, one would think so, but from a legal perspective, the concept of the bill of attainder is as dead a letter as ex post facto laws. Courts will twist themselves into shapes only obtainable in orbit rather than declare a law either of these.
