If the liberals couldn’t get 4 votes to grant cert of this interlocutory appeal (with Kagan either recusing herself or not participating for some other reason), then it’s a pretty safe bet thay Kennedy voting against granting cert.

Imagine being humiliated before a snickering Congress and hectored before tens of millions of your fellow citizens. That surely left its mark.

It is the Constitutional obligation of the Executive Branch to defend existing federal legislation—even if they don't want to.
Obama held off a bit on this one until his lawyers told him he had better do his duty or it will make his upcoming impeachment harder to prevent.

It seems to me that the likelihood of breaking a fingernail, standing a watch alone all night, having to sweat, schlep a heavy pack and risk their lives would definitely not be high on their agenda of desirable activities.
