Lone Cap and Trade Action Needs Reversal (ABQ Journal Editorial)

Sometimes being first to do something historic is commendable. Other times, it's foolhardy.

Tuesday's action by the state Environmental Improvement Board, buried by election-day news, falls in the latter category. The board — on a 4-3 vote mostly along the lines of environmental activists vs. industry supporters — approved what the state calls the most comprehensive greenhouse gas emission regulations in the nation.

Gov.-elect Susana Martinez, who opposes cap and trade, said Thursday her staff is already researching the best way to reverse the EIB decision.

Critics have said the program would cost New Mexico revenue and jobs, raise consumer prices by driving up electric rates and put New Mexico at an economic disadvantage with other states. They put the economic loss in excess of $3 billion.

Both candidates for governor opposed this but Richardson's environutters pushed it through on election day. The new administration is looking for a way to block this boondoggle from ever taking effect.

The circular firing squad is growing. I hope the new governor can stop this poison pill. The rats have finally found a winning strategy. On exit from control, create a poison pill that will wreck the economy. Use anger over the wrecked economy to regain power. Repeat as necessary.

That is, perhaps the best and most-permanent solution that we could do... IF we were still a state which a) executed the death penalty; and b) were a people who took our freedoms and liberties seriously.

Or, as I said on the thread on this subject a few days ago, if we could just go back to Tar, Feathers and ride them out of the State on a rail, we would see a little more respect for the people out of our politicians.

I don't think this is something that needs a lot of research. If the court said the unelected EIB had the authority to enact the "rules", then it is not a legislative power (though the sensible would believe by it's scope and reach it is). If it IS a legislative power the incoming executive does not have the authority to reverse it unilaterally, but neither did the unelected EIB have the power to enact it. They can't have it both ways.

So it is simple. The incoming executive must fire and replace the EIB members who voted for this ASAP, and meanwhile should unilaterally nullify the "rules" posthaste.

Just do those things and let them sue - see if they can present an argument demonstrating the executive branch does not have the power to undo it's own action.
