There have been several articles here on FR and elsewhere espousing the legislative repeal of ObamaCare. Now that the Republicans will have a majority in the House come January, this idea has some appeal. However we all know that nobama will veto any attempt to repeal, or even modify, his "signature legislation." And that we won't have the votes to override.
There is another way however. Dr. Henry Aaron explains this method in the New England Journal of Medicine. I have excerpted the essence here. The bolding is mine:
Customarily, substantive legislation authorizes spending, but the funds to be spent must be separately appropriated. The ACA (ObamaCare) contains 64 specific authorizations to spend up to $105.6 billion and 51 general authorizations to spend such sums as are necessary over the period between 2010 and 2019. None of these funds will flow, however, unless Congress enacts specific appropriation bills.
In addition, section 1005 of the ACA appropriated $1 billion to support the cost of implementation in the Department of Health and Human Services (DHHS). This sum is a small fraction of the $5 billion to $10 billion that the Congressional Budget Office estimates the federal government will require between 2010 and 2019 to implement the ACA.
The ACA appropriated nothing for the Internal Revenue Service, which must collect the information needed to compute subsidies and pay them. The ACA also provides unlimited funding for grants to states to support the creation of health insurance exchanges (section 1311). But states will also incur substantially increased administrative costs to enroll millions of newly eligible Medicaid beneficiaries. Without large additional appropriations, implementation will be crippled.
Thus Congress (specifically, the House) can just sit on its hands and watch ObamaCare wither on the vine. What could be easier?

#1 Bill to repeal, If vetoed then continue.
#2 Defund as this suggest, But do not leave the framework period.
#3 Bill to repeal until complete.
Simple and does not leave this threat out there longer than possible, even though it is UnConstitutional
No this is part of the check-and-balance power of Congress. They fund the Supreme Court and the White House.
In the past they have defunded both when issues have arisen. Haven’t done it lately, but it has been done and ought to be done again.
Executive branch enforces laws. However Congress can defund it so enforcement becomes impossible. Great for when a president wants to enforce an unconstitutional law. Supremes can rule certain things unconstitutional but Congress can defund the courts in addition to passing law that prevents Supreme Court from ruling on legal issues. Supreme court members can also be removed from the bench. It has happened, and it can be done.
I wonder how many good, seemingly necessary things are attached to some of the “obamacare” legislation, so the Socialist Democratic Party can claim that “the heartless Republicans” are failing to fund “such-and-such” programs for the elderly, the destitute, disabled Veterans, etc, etc, ad nauseum? I believe these sleazy, diabolical dims carefully crafted Obamacare legislation in a manner that would make it repeal-resistent on its own merits down the road. Republicans are really going to show us what they’re made of soon. If they fail to at least vigorously try to repeal it then we’ll know which ones have to go next election.

My suggestion is we pressure the “lame ducks” at the expense of their careers to do nothing.

I know I am one of the “WE the People” eliminate any spending for Obummercare and Obummer. No money to be spent on the ObummerCare. He has spent enough - take away his toys - planes, helicopter, limosine . teleprompter. hi busget is now 1.00. He has an income that he earned in 2009 of 5 million. let him spend that. Anything else he was to spend is his responsibility.

The ‘defund it’ approach would seem to mean that the voters would have to keep Republicans as the majority in the house every year that Obamacare is not repealed.
On the one hand, as Obama goes down in flames and the RATS are abandoning his ship, floating Rats can ‘afford’ to abandon Obamacare and claim they want a NEW, IMPROVED Obamacare lite or some other equally unacceptable thing but it lets them repeal Obamacare while telling the lefties that they are going to do it better with the ‘public option intact’. On the other hand, if Nancy Pelosi is still Minority Leader in the House - she would help punish and Rat who actually did that.
We need to create death panels for SEIU.
I wish the FBI would start looking into SEIU.
