Calif.'s Little-Noticed Prop 26 Squeaks Through in Dead of Night
By COLIN SULLIVAN of Greenwire
The same California voters who rejected a proposition yesterday that would have suspended the state's climate change law also approved a separate ballot referendum that could undermine how cuts in greenhouse gas emissions are implemented by changing the definition of environmental fees.
Proposition 26, which passed officially early this morning, will tighten how the state constitution defines taxes and regulatory fees. It has been called the "evil twin" of Proposition 23 by environmental activists who fear it would inhibit the state's ability to regulate carbon emissions.
Proposition 23 would have delayed the state's climate law, A.B. 32, until unemployment dropped to 5.5 percent for a full year. The measure was roundly rejected, with more than 60 percent of the electorate voting against it (ClimateWire, Nov. 3).
But the same voters either did not see a connection between Prop 26 and climate policy or did not care. They voted to approve Prop 26, which will require a two-thirds supermajority vote in the state Legislature for many fees and new taxes.

Excellent Smithers......
The Ninth Circus hasn’t nuked it yet.
Stupid lib voters.
They don’t like taxes though. Now the enviros can’t jack up those fees AKA taxes because they were too busy putting eevil Prop 23 to bed.
Heh. I call it Jerry Brown’s Revenge.
This is big news for New York Times readers because all the Citi’s JPMorgans, and Goldman carbon trading desks will have to focus on California to extract their wealth since Obama looks like he is giving up the Enron trading scam nationally.
The proposition passed by almost 6% - that is “squeaking” through?
Two thirds vote needed to raise fees and the taxes. The GOP’s clout gone? Not quite. The Rats can pass the budget by a simple majority but fees as well as taxes now need a two thirds vote so in practice the Dems are screwed. They still need GOP votes to increase fees and taxes and won’t be getting them any time soon.
Well between this and the likelyhood of Clooney winning once the mail-in ballots and counted as the only saving is some winners, along with Prop 20 passing and Prop 27 going down in flames...
Californians are an odd bunch. They love the statist living but hate sky high taxes.
Dems keep putting tax hikes on the ballot but they usually get shot down.
The 9th is a Federal court, not a state court.
Remember Prop. 1A? That was a vote to just extend tax increases they had already passed, and that lost by a 2-1 margin!
It’ll get there eventually [like the AZ voter ID prop. that was passed in 2005].
It is sad to watch California embrace the largest mass suicide since the Third Reich.
LOL, soon the water taps will flow with a sweet purple liquid.
Here’s the situation in Cali:
Its a 50% vote to spend money, and a 66% vote to raise money (taxes/fees).
Add this to the anointed son of the Unions and the Public Sector now Gov, on top of Cali already being underwater and unable to services its mandated benefits to public pensioners let alone normal basic infrastructure, and you have something like a perfect storm for fiscal disaster.
So does 26 change the way prop 25 will function? Does one over ride the other when it comes to green taxes or fees?
I warned as many people as I could they had successfully place two initiatives that conflict with each other.
The Democrats can pass spending bills by a majority vote. The catch is they can only pass revenue bills by a two-thirds vote. So while they can pass a budget on their own, they just won’t have the votes to fund that budget!
