Getting docketed means nothing. Every petition filed is docketed. Obama is under no obligation to respond and even if he doesn’t, there is an almost zero chance it will be accepted for review.
The upside is that if the GOP wins big, the USSC members would feel less restrained in making a decision to grant cert.
It is also possible the court will punt and send it back down to either the Circuit Court or trial court for further proceedings.
