Justification is one issue, but that wasn't the one of greatest concern to the title insurance companies. They wanted assurance there'd be no recourse after a sale ~ and BAC couldn't provide that.

Be interesting to see if they get caught doing more shortcuts.

I purchased Bank Of America shares this morning at $12.10. It closed at $12.34. I’ll sell it in the $16 range or so I think.

I somehow doubted that this was the big deal it was being touted to be.

I am willing to bet that less than 1% of those who have been faithfully paying their mortgage would be foreclosed on and if it accidentally happened, it would not be difficult to prove that the mortgages were being paid regularly.

A spokesperson told WSJ that it had not found a single case of a foreclosure without justification, which is key.

Apparently it is not "key" to the WSJ for banks to follow the established laws of property assignment.

I can’t believe that anyone actually still uses Bank of America. I use a small local bank for most of my banking. I actually get a live voice on the phone when I call there and they know me.

A foreclosure lawyer sent sent this little beauty by email last night. I had no idea the market was so robust for missing mortgage documents. And apparently there is inflation within the foreclosure fabrication circles. Prices to replace missing documents keep going up…;-)

It seems very obvious that nothing has changed except the tanking of BAC stock and what that implies.
BAC best choice is to defy the various states Attny Gen’ls and they have now been given the green light that no matter how unpleasant, Uncle Sugar will legislate them out of yet one more box its criminal behaior has created.

Foreclosures should have never been halted. Yes, there may be questions on the actual title-holder, but it’s damn sure not the one that is living there rent free.
