Nan Hayworth's bid to unseat Rep. John Hall in November got a boost Wednesday when a state judge dismissed an attempt by Hall's campaign to knock his Republican challenger off the Independence Party ballot line.
The ruling allows Hayworth to run on a coveted line that could prove critical in a close race.
Hall, D-Dover Plains, won the Independence Party's endorsement for his last election, getting 10 percent of his vote total on its line that year.
After party leaders endorsed Hayworth instead this year, Hall's campaign fought to invalidate her petition, first through the state Board of Elections and then in state Supreme Court. Both efforts voided signatures, but not enough to cost her the line.
In the court case, the Hall camp claimed that Hayworth's campaign manager, John Hicks, and supporters committed numerous infractions as they gathered signatures from Independence Party voters.
Once Supreme Court Justice Michael Lynch dismissed the case on Wednesday, Hayworth's campaign issued a statement in which Hicks said: "It's highly unfortunate that during the course of the lawsuit, without any foundation whatsoever, Hall's campaign accused some very well-meaning people mainly notaries of potential fraud and misconduct. That conduct simply didn't happen."
Retaining the Independence line is the latest advance for Hayworth, who won a Republican primary with 70 percent of the vote last week and has been on a roll with the pundits.
