UNIONDALE, N.Y. (CBS 2) He was arrested for protecting his property and family.
But its how the Long Island man did it that police say crossed the line.
He got an AK-47 assault rifle, pulled the trigger and he ended up in jail, reports CBS 2s Pablo Guzman.
George Grier said he had to use his rifle on Sunday night to stop what he thought was going to be an invasion of his Uniondale home by a gang he thought might have been the vicious MS-13. He said the whole deal happened as he was about to drive his cousin home.
I went around and went into the house, ran upstairs and told my wife to call the police. I get the gun and I go outside and I come into the doorway and now, by this time, they are in the driveway, back here near the house. I tell them, you know, Can you please leave? Grier said.
Grier said the five men dared him to use the gun; and that their shouts brought another larger group of gang members in front of his house. He starts threatening my family, my life. Oh youre dead. Im gonna kill your family and your babies. Youre dead. So when he says that, 20 others guys come rushing around the corner. And so I fired four warning shots into the grass, Grier said.
Grier was later arrested. John Lewis is Griers attorney. What hes initially charged with A D felony reckless endangerment requires a depraved indifference to human life, creating a risk that someones going to die. Shooting into a lawn doesnt create a risk of anybody dying, Lewis said.
Grier said he knew Nassau County Police employ the hi-tech ShotSpotter technology in his area and that the shooting would bring police in minutes. Cops told Guzman he was very cooperative.
Grier also said he was afraid the gang outside his house was the dreaded MS-13. And Nassau County Police Lt. Andrew Mulraine, head of the gang unit, said MS-13 has 2,000 members in the county.
Theyre probably the most organized. They almost have a military hierarchy within the gang, so they are the most organized gang we encounter on a daily basis, Mulraine said.
You may think a person has the right to defend their home. But the law says you can only use physical force to deter physical force. Grier said he never saw anyone pull out a gun, so a court would have to decide on firing the gun.
Police determined Grier had the gun legally. He has no criminal record. And so he was not charged for the weapon. That ShotSpotter technology pinpoints where a gun has been fired within 35 feet. Police said it also detected two other shootings in nearby Roosevelt that night.
Problems with ROE?
If a free citizen cannot be allowed to possess a fully-functional AK 47, then he is not a free citizen.

I don’t doubt something happened but the whole thing sounds kind of far-fetched. Seems some details were left out like why was this homeowner targeted in the first place?
You lost your country in Nov 2008 and every TV network and TV channel support him and Islam. My only hop is MS-13 decides to invade the Hamptons.

They are already there, and have been for years now. Its just that the Southhampton and East Hampton police keep them out of the celebutards hair during the summer months.
Long Island is a mess. NY Gun laws are a mess. Shots into the ground was the problem. Don’t bring it out if you ain’t gonna use it.
New York has no “Castle” laws. You must retreat, even from inside your own home. The criminals, both political and judicial rule the roost. This guy will fry unless he gets real help.
Not a good case to challenge existing NY gun laws nor for the Tea Partiers to get up in arms about (pun-intended).

Christ, I wish people would think tactically.
You cannot possibly own the ground outside with multiple subjects from multiple angles. But let them come inside the house to get you, stack them in a hallway or on a staircase.
You are also much more legally covered. A guy walking up on your grass, trespassing. A guy walking into your door, home invasion and very, very hard to prosecute criminally.
Shoot up your own house, no big deal. Put rounds downrange throughout the neighborhood, bad juju.
Lay the weapon down and stand away from it with hands exposed and immediately comply with the officers instructions when they arrive. Do not run up to them, don't try to "give" the gun to them. Just put it down and stand away from it.
Give your name and address then ask to talk to your attorney and answer no questions. Make sure that you don't say anything other than I thought he/she/they were going to kill me and do NOT ELABORATE. Then just state you no longer want to speak without the benefit of an attorney.
Don't bargain or accept their sympathies or threats. Just be quiet and sit quietly until you are either booked or released.
You must get an attorney if you've shot someone. Hopefully this will never happen to any FReepers, but remember that there are people in jail and have been civilly sued because of statements made in fear, excitement, anger and relief. I am not an attorney but have had experience with police officers both good and not so good.
They have a similar problem, they have experience with the public both good and not so good.
Wait inside until they kick in the door and then shoot to kill. Go through as many wallets as you can before the police arrive.
Thats why I love Texas, you can now use deadly force in a situation like this to defend your property. Then there is still on the books the after sundown law where you can use legal force. We had a similar situation in Dallas where a good Hispanic man emptied 30 rounds into a car outside his house of gang bangers after dark. He was no-billed by the DA. Not condoning any of this just saying you have a lot more legal choices in Texas.
What does it take to defend ones property lawfully against the unlawful legally, a paintball gun?
Defending his property against miscreants and HE is the one behind the legal eight ball because of 2nd amendment hair splitting.

When ShotSpotter technology is employed in your area, you know it’s probably time to move.
by the way under the law there is no such thing as a warning shot. Once you fire a gun you no longer have control of that round and its considered deadly. Something all hunters should be taught never fire unless you know what is behind your target and where a missed bullet will end up. I have not fired great shots I had at deer when I was not sure of the ability of the the bullet to go over a hill or into someplace I was not sure of. Thats why a shot gun is better in an urban attack like this. you have a lot less chance of shooting your neighbors kid in bed with a shotgun pellet than a supersonic rifle bullet.
