It is legal the threaten deadly force (but not to use it) to prevent criminal trespass in Arizonal. I doubt that the law is the same in New York.

Thank heavens The One has stopped the import of those M1’s from South Korea. Can you imagine the carnage if this gun-crazy homeowner had had access to to one of them instead of his “assault type” weapon? Whew, that was a close call. </sarc>
On a more serious note, it's never ever a good idea to shoot into the air, especially in a populated area. In fact, it's never a good idea to fire your weapon at all unless you intend to kill the target.

A gang of 20 is probably going to overwhelm a guy with any kind of non-automatic weapon, but fire is different.

if he waited for them to enter the house he would be perfectly legal to blow them away as long as they presented a threat....which is easy to do....especially if he had family in the house......Unless he REALLY had an "assault style" weapon, waiting that long would have been suicide. Twenty against one guy with a hunting rifle. Not good odds.

Funny thing is here in Fl because of the way the laws are written if you truly feel threatened you can kill. But it is a greater crime here to just show someone a gun.
Here if you pull out a gun on a person or people, you had better shoot someone or you will go to jail.

His defense in court:
Is the state insiting that I have an obligation to allow my family to be victims of a mob?
Is the state asserting that lethal shots are preferred to warning shots?
Is the state claiming that a 911 phone call would have solved the threat in time?
Your Honor, the Constitution asserts my right to defend myself and my family, and I did so without harming ANYBODY.
The arresting authorities took no action against the thugs that threatened my family and instead sought to restrain me from carrying out my Constitutionaly protected, God given responsiblity.
