Abercrombie & Fitch sued over Muslim scarf

A federal civil rights agency sued Abercrombie & Fitch on Wednesday on behalf of an 18-year-old woman who said she applied for her first job at the company's store at the Great Mall in Milpitas and was turned down because she wore a Muslim headscarf.

The Equal Employment Opportunity Commission went to court against Abercrombie & Fitch last year over a similar incident in Tulsa, Okla. In Wednesday's suit, filed in U.S. District Court in San Francisco, the agency again accused the Ohio company of discriminating on the basis of religion.

"This retailer that targets a youth market is sending the message that you cannot aspire to their 'All American' brand if you wear a head covering to comply with your faith," said William Tamayo, the agency's regional attorney.

Company representatives could not be reached for comment. In court filings in the Oklahoma case, which is pending, lawyers for Abercrombie & Fitch denied discriminating and said allowing the employee to wear a hijab, or headscarf, "would have created an undue hardship" for the company's business.

Federal law requires employers to accommodate their workers' religious practices unless they would cause an undue hardship. Abercrombie & Fitch's employee dress code bans head coverings.

Apparently you can make a pretty good living applying for jobs you know you cannot get, then crying discrimination.

Look for more of this BS. Wearing the hijab is more a provocation and political statement than a matter of religious observance. Muslims are using our system against us and we deserve it for being weak. In Muslim countries other religions clearly take a backseat or else.

That would be true for Catholics, Jews, Baptists, Methodists, and other Protestant faiths. Not so for those that follow islam and are muzzies. islam is a political ideology masquarading as a religion. Adherents to islam will use it as cover to justify any negative deed that is used to wipe out the infidel. No religion has the stated purpose to kill non-believers as a constant directive as islam does. Other religions have done that in the past but has long since eliminated the practice. islam continues to do so.

It will be noticed that I do not use upper case letters when typing islam and muslims. The reason for that is simple. I do not respect it and them. They haven’t earned any of my respect. If they earned it, then I would accord them that right. Until then, forget it.

Hiring officer:

“Yes, Miss Ali-muhammad, we would have hired you, but you are wearing a head scarf. Thanks for applying though.”

If I were in HR, there is NO way I would hire anyone in a head scarf. Of course there would be other reasons used. Hiring is so subjective that, short of an over statement, nobody can really know why one person was chosen over another. And some people just scream of high maintenance and lawsuit potential. They are best kicked to the street before they really DO have a case.

Actually, I’m kinda surprized A&F didn;t hire little Miss Mohammed.

I thought that A&F was into the liberal, hipster, tolerant viewpoints.

Those headscarves are not even religious. They are cultural. It would be like a German guy coming in and saying that to preserve his cultural beliefs he must be allowed to wear lederhosen every day. I wander how A&F would do with this on the sales floor:

Prayer Accommodations at School

For your children’s interest, accommodations for students taking a few minutes to catch their Dhuhr prayer are available. Please contact your child’s appropriate teacher of that particular period via email (emails can be found on metro’s website, www.mnps.org) and copy your school’s guidance counselor. Your child can also personally request the teacher as well. Letters for prayer arrangements during Ramadan (along with PE and lunch alternatives such as the library) have already been sent to all the schools. Letters for other specific accommodation have been revised and will be sent out.

Rastafarians have this same problem. They work in fringe jobs as a result.

But the business owner has a right IMO to project a clean cut appearance without headscarves or dredlocks.
