Couple in Duluth SWAT Standoff Speaks (Foreclosure)

DULUTH, Ga. - A couple who lost their home to foreclosure and spent hours locked in a SWAT standoff with police when they refused to leave, talked about the situation Thursday.

The Grabers said they were living their version of the American dream. The Grabers said they owned their home for more than a decade when Howard Graber suffered a massive stroke. The Grabers said that's when everything changed.

On Wednesday, Gwinnett County deputies went to the Graber's Davenport Park Lane home to serve an eviction notice after the bank had foreclosed on the property. It turned into a four hour standoff and SWAT teams were called in.

"I was afraid for my life. I was afraid for my disabled husband's life. There's no way I was going to go to the front door," said Noya Lee Graber.

Police eventually stormed the house. Howard Graber spent the night in jail.

"They said, 'Taser her! Taser her now!' and I got tasered right on my stomach," said Noya Lee Graber.

Good renters are a rarity.

I’ve got a friend who has built such a good reputation as a renter that property management firms send him alerts on rental properties opening up. He’s been in the same place for nearly 15 years and the place before that for nearly 10 years.

We were in our last place 14 years. A new guy bought it and wanted to remodel so we had to leave. We love where we are now.

My neighbor owns two houses and he won’t even rent to his own kids. He was planning on selling the place next to me but the market went to hell so he took it off the market.

His other place is a 100 acre farm just outside town. He leases the acreage out to a farmer and keeps a big garden for himself.

That's rather extreme but maybe he thinks the kids would slide on the rent since Dad owns it.

Our landlord rents 2 fields to a local dairy farmer. We get the rest.

“””However, if they can’t pay for the house, they can’t keep it. Tragedy, no matter how heartbreaking, doesn’t give people a free pass on responsibility.””””

unless you are too big to fail business, right?

Some animals are more = thing.

“I further think tax foreclosures should be illegal.”

Absolutely. The ability for the government to take your property for taxes makes you their slave.

Yes. I would have let the businesses fail. That was a HUGE argument on FR.

so DJ, I'll go further.....and probably an accurate future picture.

More connected or “in with the Administrations buddy circle” industries get Govt funds due to their critical importance.

“The Admin announced today that by EO, an emergency funding package will be available for certain critical print media operations to.......”

Or a bill passes called “The Farm Assist 2011 Package” and buried on page 873, is a provision to provide $400 million to select small urban business owners for yada whatever whatever”. Of course nobody would ever know because of the Bill's title and the long read of 1,567 pages.

So now Joe Somebody and his wife, who DID not overextend but who has been unemployed for a time and is about to get foreclosed upon says “what the hay, all these bailouts, rescues (TEACHERS UNION PENSIONS!!!) etc, why the heck am I the schmuck (sp?) who gets shafted.

But of course along comes the Local Law to boot out those that are not the right kind of bailoutees.

And your point? Like the liberals, you think they should get government money? I am a taxpayer. I can't afford to buy a house. Neither can a lot of people. So because this couple suffered a tragedy, we should pay their tab? What about all the other people that have tragedies? Should we pick up the tab for them too? Backing socialism/communism on FR are we? I don't think so. Charity is what these people need. NOT government money.

I hope the condition of your farm house was not a surprise and I hope you got a great deal, to make it worth it. For thirty years my wife and I have bought the worst house in the best neighborhood we could afford, fixed it up and moved up. Sometimes we got surprises on the condition of the house when we moved in. But all in all, it has been worth it.

I could very well have missed the point. Why don’t you elaborate instead of giving up? I am interested in what you meant.

Unfortunately we only rent. The farm is in NY state and much too expensive. I wish we owned it but it’s not possible.

Tasers should be banned.

Yeah, using a gun is MUCH better.

Personally I don’t think police should be involved in enforcing foreclosures between the bank and citizens. That isn’t to say that the bank is or isn’t in the right, just that police should not be used.

What else is the bank supposed to do? Just let the people sit in the house that they refuse to make the payments on. I see, the bank has plenty of money, they should just let anybody renege on their responsibilities who wants to.

OK, I'm not advocating freebies. What I did was paint an accurate picture of what is happening right now and what WILL continue to happen under our present Admin and Congress. I don't know of another way to explain the anger that will erupt as decent citizens continue to see bailout packages for some, nation killing amnesty, job destruction, etc.

I'll add another point. And I'll preface it that your opinion and mine too are worthless in the grand scheme. What is going to happen is going to happen. To those folks that love to say “I made all the right financial decisions why should I pay...”

Guess what, I agree you and I are getting shafted. But to think you and I are insulated because we did the right thing is naive and foolish. Current govt WILL get us in other ways and so will rampant crime as thing gets worse.

I'm a slow typer, takes me too long to make a point. To sum it up, if this economy doesn't turn around soon, financial responsibility may not be worth much. God's Grace, some luck, some planning and then what happens will happen.

So any other bill disputes you want police intervening in?

Excepting the use of the taser, this case is one of property rights. The bank forecloses and re-assumes ownership on non-fulfillment of a contract. If the bank couldn’t get possession of this property, why would they loan on other future properties.

You know, this is a big issue in Central and South America where squatters kill private ownership of property. You buy a property but soon squatters move in and are awarded possession and ownership of your property. This lack of property rights contribute greatly to their third world status.

Unfortunately, this is a tragedy for these people. It would be unreasonable to assume they could have saved enough money to prevent this mortgage calamity and their (probably) mounting medical bills. This is where family, first, comes in... and community second. Not the bank.

I agree. The libs in DC intend to ruin America and call it "equal". That is what all this is about.

I am surprised though that this man did not get SSI disability and/or a charity didn't step in. I guess charities are as strapped as the rest of us.

However, if they can’t pay for the house, they can’t keep it.

Give it back to the banksters and fat corps who were bailed out to the tune of trillions, by the Grabers along with millions of other Americans.
