Judge Walker Lifts Stay on Prop 8 Ruling: Gay Marriage to Resume in California on August 18th

Judge Vaughn Walker has lifted the stay on his Proposition 8 ruling, which deemed a ban on gay marriage as unconstitutional.

Walker's ruling last week was ground breaking, but it still kept the ban on gay marriage intact, until Prop 8 was ruled on by the 9th Circuit Court of Appeals. Walker has now removed the stay, and will allow for gays and lesbians to marry in the state of California.

Walker said that he would lift the stay on August 18th. The LA Times reports that the temporary hold on gay marriage is to allow supporters of Prop 8 time to appeal the ruling.

Walker says that gay marriages can resume on August 18th, unless a higher court ruling blocks them....

Disobey the black-robed tyrant, obey the US Constitution. The judge's ruling is clearly unconstitutional as it violates the 10th Amendment. There is no text I can find in the Constitution that addresses the issue of the legal definition of marriage. The 10th amendment says in that case those powers are reserved for the states and the people. The state and people of California made their decision on the issue and codified it by amending their state Constitution. At that point, the feds have no jurisdiction.

When the will of the people is ignored by supposed authority, when the ballot loses all meaning and purpose, what is it that they expect the people to do? Simply rollover?

For me, there is much more going on here than the obvious question pertaining to gays. This is one more example of how our country is being ripped apart by the traitorous libs.

I do not know how this nightmare will end, but it most assuredly it will.

Walker is actually a rather conservative judge on other issues; he is one of the more business-friendly federal judges in California. He was originally nominated to a judgeship by Ronald Reagan; the Democratic-majority Senate refused to confirm him because they said he was anti-gay(!). (In private practice, he had represented the U.S. Olympic Committee in a suit against the Gay Olympics for trademark infringement). He was eventually successfully nominated by G.H.W. Bush.

The only one with the actual power to "disobey" the ruling is Governor Schwarzenegger, and he has said that he supports the ruling and is refusing to appeal it (he is the named defendant in the suit). Ted Olson (the lawyer for the plaintiffs) is now saying that the appeal is moot because the defendant agrees with the decision.

This will get interesting at the appellate level. (If I had to make a prediction, I would guess that the 9th Circuit will deny a stay but that the Supreme Court will grant a stay by a vote of 5-4).

The good thing is this judge went so over the top substituting extremist left wing platitudes as findings of fact that is should be easy to convince Kennedy to shoot this down.
