That argument has never held water (no pun intended) because our enemy in this war doesn't follow any kind of "rules", and doesn't base their behavior on whether or not we do. Do you really think that they waste one second thinking, "Gee, I was going to cut this American soldier's head off, but I think I'll let him live because I suddenly feel all warm and fuzzy inside now that I've heard how well the Americans are treating our brothers in Guantanamo."? Do you seriously believe that they make that calculation?
Of course they don't. They do what they do, just like animals, and couldn't care less how we treat them when captured. In fact, when we tie ourselves into knots in misguided attempts to prove how "sensitive" we are, it merely emboldens them by demonstrating how weak we are.
The ONLY way to actually win this war is to completely obliterate the enemy's WILL TO FIGHT. Pinprick drone strikes and apologies for what little offensive measures we do undertake only make the situation worse. We have to so demoralize them (ala Japan or Germany in WWII) that they will no longer even entertain the idea of attacking us.
What we should have done after 9/11 was, as soon as practically feasible, launch massive strikes against any countries known to actively support Islamic terrorism. Following that, we should have warned countries that more passively allowed terrorists to thrive in their countries that if the U.S. were ever attacked again, we would annhilate them, too. I wouldn't get into this game of trying to figure out who was involved in 9/11 (was Iraq, wasn't Iraq, etc.). I would just put the entire Muslim world on notice that if it ever happened again, they would ALL pay the most severe price. Let them sort out who is who, that's their problem.

How sad we have to do this. The judiciary is out of control and only seems interested in protecting monster- not our citizens...
