California Atty. Gen. Jerry Brown urged a federal judge Friday to permit same-sex marriages to resume in the state immediately.
Brown told U.S. District Chief Judge Vaughn R. Walker that his historic ruling that overturned Proposition 8 probably will be upheld by higher courts. He said his office last year opposed a pretrial request to block Proposition 8 only because the legal and factual issues had not then been explored.
"That has now occurred," Brown's office said. "And while there is still the potential for limited administrative burdens should future marriages of same-sex couples be later declared invalid, these potential burdens are outweighed by this courts conclusion, based on the overwhelming evidence, that Proposition 8 is unconstitutional."

Once Walker opens this door, it will be hard to close.
Ok what does this do to Brown in his run for Gov. of Cali.?
An activist judge already did this in California a couple of years backthwarting the constitutionally-valid vote of THE PEOPLE. Our votes here mean NOTHING.
Gay HoneyMoonbeam! Think Ahhhrnaald was a disaster for Ca? Just wait for round 2 of MB coming to the Sacto asylum. Ca. is FUBAR.
Also, Meg has not gone sufficiently negative in her ads. She needs to give CA a history lesson about Rose Bird.
Hard to believe they gave this guy a law degree.
I wonder who Moon Beam is wanting to get hitched with.
This language is part of the California Constitution. This A Hole is supposed to be defending it in court whether he likes the Amendment or not.
Whitman better mention that Jerry Brown is showing us how bad of Governor he will be because he will not follow the Constitution of the State of California if he disagrees with it.
It may not matter because a large part of these groups only look for D’s on the ballot no matter how bad they are. Whitman has got to try though.
They keep using Prop 8 as the lingo, the pro marriage forces need to say this is the California Constitution we’re talking about.
So when the government gives the go ahead on drilling projects, power plant projects etc...I assume Jerry would be fine with allowing them to be started while the EPA brings its lawsuits?
Yeah, didn’t think so.
This clown is doing this just for homosexual votes.
An appeal for a stay would end up before Justice Kennedy.
I don’t think Walker wants to give Kennedy that headache.
