Whoever qualifies to run for the U.S. Senate in Illinois also qualifies to run for the special election.
That's the final decision U.S. District Judge John Grady made today. He had toyed with letting party leaders pick the candidates but he opted for the less confusing route.
That means Rep. Mark Kirk with be the Republican candidate. State Treasurer Alexi Giannoulias will be Democrat. LeAlan Jones will be the Green Party candidate.

Grady said the state Board of Elections must certify a winner in the race by Nov. 24, though they could do it even earlier, giving the winner of the special election an even bigger head start.
The loser in today's hearing was Appointed Sen. Roland Burris. Burris' attorney argued that he should have a chance to serve out the last six weeks of his appointed term.

The net effect of Grady's ruling is that whoever wins the Nov. 2 election for U.S. Senate -- presuming voters pick the same choice in both elections -- will take office six weeks earlier, gaining more seniority than the other new senators elected around the country that day who will not take office until Jan. 3.

I’m sorry, this may make things easier, but what is the legal justification?
Right after Burris was appointed, a lawsuit was filed alleging some paperwork irregularities — I forget exactly what, but something states are supposed to do whenever such an appointment was made — and saying that the people of Illinois had a right to elect Obama’s replacement in a special election. The problem is that it took so long to get to a decision, that the earliest we could get a special election is this November. So we’re in a position of having two elections — the special one to remove Burris and fill the rest of Obama’s term, and the regular election for a new term starting in January.
Illinois is going to get an ultra liberal lying sack of s*** as a U.S. Senator no matter what.

Concur, however at least Kirk votes for leadership, as well I have relectantly learned that in certain situations (but not most of them) a RINO is marginally better than a Pinko Communist.
Plus, I don’t want to be hearing about “Senator Giannoulias” for the rest of my life.

In IL, anything is possible. If Alexi is indicted before the election, the Dems (their wing of the Combine, of course) might replace him with someone else. There have already been LOUD calls from the base for Kirk to step aside because of his record, his lies about his military record, and now even an alleged attempt at suicide in Lake Michigan as a young man. Hell, Jack Ryan was forced off the ticket after he won the Senate nod in ‘04 all because he wanted to have sex... with his OWN wife !
In 2004, the IL GOP State Central Committee nominated Alan Keyes, from Maryland, without considering the opinions of many other Republicans. If we have a special election, I hope that the IL GOP SCC will poll all 102 county GOP chairmen and nominate the most popular candidate, according to those chairmen.
