This isn’t a constitutional issue, it’s a UCMJ issue.

This man disobeyed a lawful order given to him by his commanding officer.

Here’s an example: A Petty Officer Third Class doesn’t want to deploy with his ship because he doesn’t believe the CinC has the constitutional authority to deploy him. Can that PO3 then disregard the lawful orders given to him by his PO1, CPO, LT, CAPT, ADM because he doesn’t believe the authority of the CinC?

How ‘bout if the CinC’s credentials were already validated by the certifying authority? Would that help or hinder the PO3’s case?

You just forget that he swore an oath to the Constitution, which is HIS conviction. He did NOT swore an oath to the commanding officer or to the Commander- in-THIEF!!!

So now he doesn't have a right to refer to his Constitutional rights???

How ‘bout if the CinC’s credentials were already validated by the certifying authority? Would that help or hinder the PO3’s case?

Where and HOW were these validated, isn't that what the whole case is about???

It depends entirely on whether or not I like the CinC.

And which party he's in. That too.
