John Jay underlined the word *born* in the phrase “natural born citizen” in his letter to George Washington:-

I remain, dear sir, Your faithful friend and servant, John Jay. ---------------------------------------------------------------------------------------------- Obama may well have been born a British subject in 1961, if his father was, as Obama always said, Barack Obama Senior.

It may seem strange, but at the time subjects of the empire had the right to move to and live in the UK because the British Nationality act of 1948 made them effectively British.

Many thousands of Carribean folks took up the offer, which possibly led to the act being repealed later. I think your arguement that we are claiming Obama has to this day a burning loyalty to Her Majesty the Queen is a strawman.

Obama COULD have claimed UK citizenship, but he did not. He could have claimed Kenyan citizenship, but he did not and cannot do so any longer. He also would have needed to renounce US citizenship in writing to become a Kenyan.

He was primarily raised in the USA with a US passport. No evidence has surfaced of a UK passport.

Thus he is not a dual citizen with dual passports and presumed loyalty. And he certainly does not possess any loyalty to the UK.

There is an argument to be made that Obama is not a NBC, but the predominate opinion in the 1900s is that he IS a NBC. The US Supreme Court has never ruled on the meaning, nor do I believe it ever will. Had they been inclined, they would have done so in Dec 2008.

I am sympathetic with the birther arguments that dual citizen parents are required for NBC. That is actually how I would have interpret the phrase until I read about the legal history of ‘natural born subject’. I find that argument stronger, and it can be found as discussed by the Indiana courts here:

I am not sympathetic to the idea that anyone who disagrees with the birther legal theory is a traitor who loves Obama.
