Testimony Sought of “Custodian of Records” AND Production of all records relating to President
Decision to be made by Army Major General
Washington, D.C., July 29, 2010. The Army doctor who is facing a court martial for refusing to obey orders, including a deployment order for his second tour of duty in Afghanistan, has formally requested his Commanding General approve a deposition in Hawaii of the records-keeper of the State Department of Health—and the production of all of their records concerning Barack Obama.
The records Lakin seeks have been the subject of intense interest ever since the closing days of the 2008 presidential campaign when a document appeared on the internet purporting to be a certification that Hawaii’s Dept. of Health had records showing he had been born in Honolulu. Since then, Dr. Chiyome Fukino the head of that agency has made public statements on the subject, but has refused all requests for copies of the actual records in the Department’s custody. Recently, a former Hawaii elections clerk has come forward saying that he was told that the Department’s records showed Obama was NOT born in Hawaii.
The United States Constitution requires that a person be a “natural born citizen” to be elected to the presidency. If Mr. Obama was not born in Honolulu as he has claimed, then he is unlikely to be a “natural born citizen”. An examination of the records kept by the Hawaii Dept. of Health are an essential first step in ascertaining Mr. Obama’s constitutional eligibility to hold the office to which he was elected in 2008.
While no civil litigant has obtained discovery of these records, and all the civil lawsuits seeking those records have been dismissed on procedural grounds, Lakin’s case is different because he is the subject of criminal prosecution, and upon conviction stands in jeopardy of being sentenced to years at hard labor in the penitentiary.
Lakin’s request was submitted by his counsel to the Commanding General of the Military District of Washington, Major General Karl R. Horst, under Rule 702(b) of the Rules for Courts-Martial, which provides that “A convening authority who has the charges for disposition or, after referral, the convening authority or the military judge may order that a deposition be taken on request of a party.”
Lakin’s civilian attorney has been provided to him by the American Patriot Foundation, a non-profit group incorporated in 2003 to foster appreciation and respect for the U.S. Constitution, which has established a fund for Lakin’s legal defense to LTC Lakin. The German government a few years a go sent my neighbor's son a letter in the United States saying he had to do compulsory German military service and he was born at Landstuhl, Germany at the US military hospital. He was born of two American citizen parents and the German government had a claim on him.

I believe (one of) his civilian attorney stated on one of the radio programs they were interviewed on...that they would pursue all aspects of the usurper in office issue. No proof of birth in HI, and that he was born to a foreign father and he himself was born a subject to the crown of her majesty the Queen of England.
My understanding is that they are aware of both issues.

No one born of American parents in Germany, raised in the US, has been forced to serve in the German Army by US Courts. That is hogwash, and suggesting it happened is dishonest.

That depends on how many years the young man spent in Germany.
If he was resident in Germany for some years prior to the time, he may have had some hassle.
For German authorities to send a letter abroad would seem to be rare at the very least. Must be some odd circumstances at play.
This is perhaps the most surprising argument birthers make--that one's U.S. citizenship is affected by a foreign country's laws. Not only that, but these foreign laws have an effect on the eligibility of our own President. This is not a conservative position. It's another example of how this hysteria is forcing conservatives to adopt some strange views and blindly follow dubious characters.
If anything, the CO should have listened to Lakin and used his CMH status as a leader concerned with the Constitutional viability of the Kenyan fraud posing as Commander in Chief. But that didn't happen because personal success supercedes what is good for the Troops and good for the Nation for far too many of the tools in the military hierarchy these days.
Such a brave move would have further vindicated those of us who give a damn about this magnificent Country and its Constitution, plus it would have instilled a lot more fear into that criminal POS who is hellbent on destroying America.

The US government recognizes duel citizenship and the possible claims by a foreign country may have on that person...because of the allegiance that person has to their respective foreign country which that person has citizenship.

The majority of military folks I know believe Lakin has a duty to deploy. Period. That does NOT make them (nor me, nor Lakin’s CO) traitors, nor does it mean we gain some personal advancement.
Or he has made a judgement that Obama will go rogue and attempt a coup after he replaces Gates as SecDef.

In general I would guess that Lakin feels the US is in great danger, hence the high stakes act of resistance even if it meens his own immolation.

IF someone claims dual citizenship and has multiple passports, then they have obligations to both. But a foreign government cannot require Obama nor any other person born on US soil to be their citizen, to obey their laws, serve their military or impose allegiance.
If it could, the Soviet Union could have made us all citizens, and no one could have been President, and they could have won without spending a penny.
