Breaking: Judge Rules on Arizona Immigration Law

strikes down the portion of officials demanding papers from immigrants....no word yet if she has decided this law trumps fed law but she has not struck down entire law...

It's interesting that I've not seen any reference to US Code 1252c:

§ 1252c. Authorizing State and local law enforcement officials to arrest and detain certain illegal aliens

(a) In general
Notwithstanding any other provision of law, to the extent permitted by relevant State and local law, State and local law enforcement officials are authorized to arrest and detain an individual who—
(1) is an alien illegally present in the United States; and
(2) has previously been convicted of a felony in the United States and deported or left the United States after such conviction,
but only after the State or local law enforcement officials obtain appropriate confirmation from the Immigration and Naturalization Service of the status of such individual and only for such period of time as may be required for the Service to take the individual into Federal custody for purposes of deporting or removing the alien from the United States.
(b) Cooperation
The Attorney General shall cooperate with the States to assure that information in the control of the Attorney General, including information in the National Crime Information Center, that would assist State and local law enforcement officials in carrying out duties under subsection (a) of this section is made available to such officials.

1252c specifically authorizes states to arrest and detain certain illegal aliens. How does this judge expect the states to comply with 1252c if they cannot first determine if the person is an illegal alien, and then determine if said illegal alien has committed a felony?

The Feds won't bother asking them either. They'll just release them from custody.

OK, since the state can't help us and the feds won't, the only recourse is to find out who is employing these illegals and start some serious gorilla protests against them. 70% of the people of Arizona want this, let 70% of the people of Arizona start turning their backs on anyone who hires them. I'm talking pickets, following them around, picking their "clubs" or when they attempt to take clients to lunch. Shut down small businesses that hire them but refusing to purchase their services, turn them in to general contractors if they are construction oriented and tell the generals you will file suit against them unless they cancel any contracts with illegal harboring subs.

It’s been going on for a long time in El Paso. So sad that our own citizens have lost the protection of our government, yet these really bad guys are protected.

Gov. Brewer needs to call an immediate press conference and say that as the elected governor of Arizona, she is going to enforce the laws that the elected legislature enacted, and that her constituents overwhelmingly support. If she is held in contempt, the GOP platform is set for November. A federal government run amok and imposing its will and power on states.

Call Obama’s bluff, since obviously this judge is in the pocket of the DOJ.

The natural reaction - The states should refuse to enforce or assist in enforcing all federal laws in any way.

Next Step - remove any and all federal employees from state property. Simply evict them....

Well, let’s see here. If nobody can be checked for an ID or citizenship then I guess that this would apply across all 50 states. OK, I’ve always wanted to attend, let’s say, Cal Poly or maybe another prestigious public university. So, I should be able to just go there, demand entry to the university, demand a full scholarship as well as room and board and get it. No, no, you can’t ask me for any ID, proof of residency, financial records to prove need or anything else. Give me what I want you democrat POS Nazi morons. Yeah, right.

I'll be curious to see if the Arizona legislature spits or swallows this ruling.

As said by callers, listeners on Rush's show, enforce the AZ law anyways saying to the judge Bolton you enforce your ruling. It seems to be getting to that point...

Let the judge come to Arizona and try to stop it.

The judge lives in Arizona. Probably not for very long because she's about to become the most unpopular person here. Her life is not in danger, but it's not going to be pleasant.

Rush just said the muzzies will have a field day with this. Gov. Brewer needs to point this out, ASAP.

Dems have just sealed the deal for November.

Which means they still need to show their drivers license, proof of insurance, etc.

It sounds like this impacts what would go on at the station when they bring the person in. I’m not in law enforcement so I don’t know what the real world ramifications of this ruling would be regarding routine traffic stops.

Good news is that she didn’t strike it, she only temporarily blocked it.

In my above post I said that by the time the appeal reaches the Supremes, Obama will have amnesty.

Darned if Rush didn't quote me word for word a minute ago....thanks Rush. Great minds think alike, LOL.

Rush added that the SCOTUS doesn't convene until October. He's darn near calling for some kind of planned resistance right now without saying what, how or when.

This is a dangerous sitution this crazy judge has initiated with her ACLU-inspired, fascist ruling.

She's a Clinton appointee in case anyone isn't aware of this.
