Theyre baaaaack! The Democrats, in their persistent view that anything which possibly can be taxed should be, are again proposing federal legislation to impose sales taxes on interstate purchases made over the Internet.
The measure, H.R. 5660 sponsored by Rep. Bill Delahunt (D.-Mass.), has the Orwellian title of the Main Street Fairness Act. New-speak continues in the subtitle: To promote simplification and fairness in the administration and collection of sales and use taxes; and for other purposes. At least the last four words are accurate.
The other purposes in this case are the attempt to collect billions of dollars from consumers to plug states budget gaps while kneecapping Internet-based merchants for the benefit of brick-and-mortar stores.
The measure attempts to get around one reason that the Supreme Court, in the case of Quill Corp. v North Dakota, ruled against a states attempt to apply a use tax on items purchased by mail-order from an out-of-state vendor. Namely, that many variations in rates of tax, in allowable exemptions, and in administrative and record-keeping requirements could entangle [a mail-order house] in a virtual welter of complicated obligations" and thereby burden interstate commerce.

An internet, or any interstate sales tax is unconstituional. There’s now way around it.
Article 1, Section 9, Clause 5 of the Constitution says simply: “No tax or duty shall be laid on articles exported from any state.”

I first learned about this frightening catch-all when I saw it attached to Dingell's initial Obamacare bill last summer.

It scares the bejeebers out of me, because you know they mean it -- anything they want to throw in there without us knowing about it.
The tax is on sales. If the use tax were greater than the instate sales tax there could be a problem.
Hey,if the Second Amendment only applies,in the opinion of "progressives",to the "militia" then those same "progressives" could argue that that clause only prohibits the state *from* which the item is exported from levying a tax.

They’ll certainly try. With how unfairly waited the tax system is in this country it is a person’s patriotic duty to try to minimize their tax liability any way they can. Internet sales are a good way to do that.
I heard an interesting idea a while back. A person was advocating uncoupling taxation from income or sales. The amount needed to run the state or country would be tabulated then divided equally by the population, business, etc. Everyone would have “their share” to pay regardless of income. It certainly got me thinking.
Purchasers are required to report out of state purchases on their state income tax forms in Michigan, and remit the 6% sales tax to the state. What do states without an income tax do?

Starting this year EBarf is issuing 1099’s equal to the total auction sales for the year, as taxable income, and it’s up to you to convince the IRS what the cost basis of those items are.
Just the first tooth biting into “the internet.” There will be more. They will seek to control as much as they can.
