WHEAT RIDGE, Colo. - Legal analyst Dan Recht said he believes the Jefferson County District Attorney is "seriously overcharging" a Wheat Ridge homeowner, accused of attempted first degree murder for shooting at two thieves.
82-year-old Robert Wallace said he fired two shots at two men when they tried to run him over while stealing his flatbed trailer.
Wallace now faces twelve felony counts, including four counts of attempted first degree murder, for what he described as an act of defending his property and his life. If convicted, he could spend the rest of his life in prison.
One of the thieves, Damacio Torres later admitted to the theft. He and his partner in crime, Alvara Cardano both have prior arrest records and are believed to be in the country illegally.
But they are not facing any charges.
Recht said, in his experience, prosecutors overcharge cases to force a person to plea bargain. He argued that it's just not right to put a person through that kind of mental and financial stress.
Jefferson County DA, Scott Storey, indicated he'll take a closer look at his office's decision to throw the book at the homeowner and hinted the charges could be reduced. He said the investigation continues into the confessed thieves.

Now that just makes me mad. The guy’s tools (his livelihood,) were loaded on that trailer. I don’t know if he got those back.
Situations like this will set a bad precedent. Same result can come from elderly man at home asleep and 2 illegal alien burglars from Mexico attempt to rob and kill him but homeowner shoots and wounds both burglars which flee and call the police. Guess who is going to jail?
Thieves could go free while victim faces jail time
Minutes later, police say 32-year-old Damacio Torres dropped 28-year-old Alvaro Cardona off at a hospital emergency room with a gunshot wound to the face.
In the video it states that Mr. Wallace did get his trailer back. One of them, Torres, is supposed to be part of a major car theft ring.
It was mentioned on Peter Boyles program that they hid the trailer first before going to the ER.
Another case of the supposed upholder of justice and the rule of law betraying the people.
Do these idiots really not understand what’s coming down the pike if the general populace loses faith in the rule of law? Hard to believe someone this stupid has a position of power. Or rather, in an America that would elect obama, it’s not. But it is terrifying.
Hmmmn - a man shoots at two thieving Messicans caught in the act of stealing, the victim is three times older than the Messicans, and shooting at the thieves is wrong in precisely what way? ? ?
Arguably, Boulder dementia Syndrome has spread across Colorado.

What a wonderful justice system we have. The victims are fined and jailed while the perpetrators go on their merry way to the next victim.
Besides stealing, if they tried to run over the old man, THEY are guilty of attempted murder!

Trying to run somebody over with a vehicle is assault with a deadly weapon. It is SOP for police officers to shoot the driver in such a situation.
If the D.A. doesn’t drop it, I’m sure Peter Boyles will have some info on that at a future time. One of the many good things about Boyles, he doesn’t let things go.

It’s about more than immigration, and whether or not a nation and society can assimilate a migrating hoard.
Illegals are working at the behest of parts of our own government. This shadow, fascist state working inside our own government, is not only encouraging them to over-run our boundaries, it is enlisting them as agents of a program to seize property from citizens.
That’s the way it now looks.
Obviously somebody is after the old codger’s land, God defend him. It’s really an old story, a pattern that anyone should understand.
What makes me shudder, head to toe, is the fact that everyone involved in this fiasco, excepting the man and the two perps, boasts a college degree or more. I used to think that education made people wiser, more rational,humble, more respectful of rights of property, more circumspect and devoted to truth. There has never been less humility, respect, devotion, reverence, reason, rationality than now. This decadence took root when a university education was deemed a necessary right of passage and adolescents were culled out of their communities and installed within faux Georgian and Gothic compounds for four years of debauchery and propaganda. “Higher Ed” now the gatekeeper to the middle class as well as the upper managerial class. And, the only things being taught arrogance, contempt, and presumption.
If and when we win back this country,the first thing we should do is kill all the college professors. Leave the lawyers alone.
