WHEAT RIDGE, Colo. - Legal analyst Dan Recht said he believes the Jefferson County District Attorney is "seriously overcharging" a Wheat Ridge homeowner, accused of attempted first degree murder for shooting at two thieves.
82-year-old Robert Wallace said he fired two shots at two men when they tried to run him over while stealing his flatbed trailer.
Wallace now faces twelve felony counts, including four counts of attempted first degree murder, for what he described as an act of defending his property and his life. If convicted, he could spend the rest of his life in prison.
One of the thieves, Damacio Torres later admitted to the theft. He and his partner in crime, Alvara Cardano both have prior arrest records and are believed to be in the country illegally.
But they are not facing any charges.
Recht said, in his experience, prosecutors overcharge cases to force a person to plea bargain. He argued that it's just not right to put a person through that kind of mental and financial stress.
Jefferson County DA, Scott Storey, indicated he'll take a closer look at his office's decision to throw the book at the homeowner and hinted the charges could be reduced. He said the investigation continues into the confessed thieves.

In Texas, the grand jury would let him off with the “they needed killin’” defense. Which in cases like this, makes sense. They were threatening his life, and he shot back at them. Ought to be end of story, if there’s nothing else significant to the story that’s yet to be learned.
Doesn’t rule out RINOs, sadly.
Illegal aliens with prior records who admit guilt don’t get charged, while a homeowner defending his property gets charged with attempted first degree murder for almost being run over and deciding to defend his property.
Stories like this one make me want to see the prosecutor hanging from the nearest tree.
Take it to trial. No jury will convict him if he has a competent attorney.
Story doesn’t mention if the 82 year old even got back the trailer the illegals STOLE from him. Also if it was a white males attempting to run over 2 illegals the guy would be charged with attempted vehicular manslaughter most likely a felony charge and these illegals likely will go free and tell all their illegal buddies back home what a joke the kangaroo courts are like in the US.
If he isn’t sucked dry by the attorney fees incurred in fighting each one of the “throw the $hit at the wall and see what sticks” charges.
Sounds like the prosecutor should hang his head in shame.
I don’t know about the trailer. I wouldn’t be surprised they didn’t let the illegals have it. A couple of other things I forgot to mention, there was some talk on Peter Boyles Wednesday show that the illegal that was shot in the face may sue Mr. Wallace. Also, Peter Boyles was saying today that he heard the amount of medical bills for the shooting was in the $500 to $600K range.
Interesting. The story doesn’t even mention that he even hit the illegals, just that he fired 2 rounds at them. Do we know if one was legitimately shot or does something smell rotten in Denmark?
I believe that Boyles said on his show that one of Mr. Wallace’s lawyers is Larry Pozner. I don’t think he comes cheap:
