Kagan disses natural rights, Declaration of Independence

This is a question from Tom Coburn yesterday. He asked her about the whole business of natural rights. She's not sure! She is not sure on the Declaration of Independence. Yesterday Tom Coburn (R-OK): "Do you agree that the natural right of resistance and self-preservation -- the right of having and using arms for self-preservation and defense. He didn't say that was a constitutional right. He said it's a natural right. I'm asking with you: Do you agree with that?"

KAGAN: Senator Coburn, t-t-to be honest with you, I -- I -- I don't have a view of what are natural rights, independent of the Constitution. And my job as a justice will be to enforce and defend the Constitution and other laws of the United States.

COBURN: So you wouldn't embrace what the Declaration of Independence says, that we have certain God-given, inalienable rights that aren't given in the Constitution? That they're ours and ours alone and that government doesn't give those to us?

KAGAN: Senator Coburn, I believe that the Constitution is an extraordinary document, and I'm not saying I do not believe that there are rights pre-existing the Constitution and the laws, but my job as a justice is to enforce the Constitution and the laws.

BS. It is a simple legal document which restricts the Federal govt. to certain limited and specific powers. It is no more "extraordinary" than any other law. They should bring up the 10th Amendment and ask her if she intends to enforce that as law. Of course, none of the Pubbies in Congress has taken it seriously either, but...

She can consider foreign laws when interpreting the Constitution but not the principles of natural law that our Founders spoke and wrote extensively on as the basis for our Constitution. She’s a commie.

Elena Kagan pulled a major gaffe on the Declaration of Independence and the American public is not sold on her nomination, but the DemocRATS still are pushing her through and the Republicans are still too cowed to stop it. These are not happy times.

The Constitution without the Declaration of Independence is a WORTHLESS document.

The Constitution is simply the LETTER of the law while the Declaration of Independence is the Spirit of the Law, which gives the practical letter of the law PURPOSE.

This is really Biblical.

Jesus coming was the FULFILMENT of the law.

But those Jewish lawyers known as Pharisees could not grasp the spirit of the law because they were simply mechanics who had grown very fond of manipulating the law for their own selfish ends.

Kagan is a mechanic and a Pharisee of the highest order who is probably quite Godless and incapable of grasping forces larger than temporal.

This cannot be said too many times.

The Declaration was written as an override of the European Divine Right of Kings, giving self-rule & determination to free men & women (formerly the peasantry), who were endowed with The Natural Rights of Man by their Creator.

Anyone who rejects the Declaration is an oligarch, who wants to return to rule by the oligarchs, of the oligarchs and for the oligarchs - in two words: Despotism & Tyranny.
