Three judges on the 3rd U.S. Circuit Court of Appeals are beginning to review a case that alleges Barack Obama is not eligible to be president – in fact, he may not even be American.
Arguments earlier had been scheduled for June 29 in the dispute, but a court order recently cancelled the hearing and instead announced the case would be decided based on the merits of the legal briefs submitted by attorneys.
A document from court clerk Marcia Waldron said the case will be decided by Judge Dolores Sloviter, who was appointed by Jimmy Carter; Maryanne Trump Barry, who was appointed by Bill Clinton; and Thomas Hardiman, who was appointed by George W. Bush.
The filings were due on the day the hearing would have been held, but there's no published timetable for a decision to be released.

He was born to a mother who was a US Citizen and went to school in the US WELL before reaching the age of majority and since he was never a naturalized but possesses a US Passport, was admitted to the IL Bar, was elected to the US Senate and then as US President, that must make him a citizen at birth.

I have never defended Barack Obama, on this board or anywhere else. But, I will defend logic, reason and the correct application of US law. And, I'm a person who is NOT given to belief in wild, fanciful conspiracy theories.

I think it's telling that you gent bent out of shape when someone speaks the plain truth, especially about this subject. And, with respect to this particular WND story, it is riddled with inaccuracies (not the least of which is the title), that it make it laughable, and it should be embarrassing for anyone who values intellectual honesty and accuracy in media reporting.
I will repeat what I initially said; The WND story is so wholly inaccurate that the writing could have been bettered by a grade-school student.
So they fabricate some new dramatic twist to an old birther story every couple of days and voila'...the hits just keep on comin’.

Whomever wrote this "article" for WND clearly doesn't begin to comprehend the purpose of appellate courts in the US. To posit, as this story does, that this appellate court will be a trier of fact, is a statement that flies in the face of American jurisprudence.
Again the title, "Appeals panel considers whether Obama is even American"", is completely inaccurate. The 3rd Circuit is NOT going to review the merits of the case, nor are they going to review the facts of the case. All they are going to review is the trial court's application of the law with respect to the granting of MTD on the grounds of lack of standing. That's it.
I should ask my English teacher about inaccuracies in describing US law? Really? Perhaps that's why you're so confused about this issue. You're relying on English teachers for legal advice.

On the thread topic, I think WND covers the legal cases poorly, with the headline usually being far too simplistic and/or sensationalist.
However, Obama was born to a Mother under 19 years of age and to a father [Barack Obama Snr] who was never a citizen. Those are part of Obama’s admitted life story.
If that birth was outside the USA in a third country, then Obama is *not* a US citizen.
Claiming that changes to the US Law made in the 1980’s are retroactive wont work, it is the law at the time that matters.
Because Obama will not produce a full primary birth cirtificate, there is real doubt that the man is US citizen.
Obama’s Senate passport proves nothing as that is provided automatically with no checks at all, it comes with the job.
Where he went to school is irrelevent, as is the IL Bar qualification.
Expressing a logically valid opinion should not be condemed even it is unpopular with the elite Political class.
Whatever MSNBC, ABC, NBC, CBS or CNN do, it will be to protect their investment in Obama, that they are hostile to any challenge should not stop people seeking the truth.
I believe Obama can be investigated by Congress if the majorities change in the house in Nov. and especially in a corner case Senario, the senate as well.
I think the investigation should be something simple, like social security fraud.
Well I am not a Viking Kitty, but if I were any level of Obama-defense would bring on an overpowering scent of ozone. I cannot personally think of one thing—not ONE—that I would defend about this man. Some say he is a good father/family man. I’m not on the inside of that loop, but I do not believe MO would be quite so angry if he were as good a husband as some seem to think. As to the girls, what little I have seen of them, they come off as weirdly lifeless and inanimate. Iow, there is something deep and fundamentally wrong in that home. Having survived a very dysfunctional family, maybe I am more attune to it than others. Again, I can’t prove it; it’s just the sense I get.
Otherwise, I believe Obama is the most uniformly evil-acting person I have ever known or encountered. He lies, he destroys, he hurts and harms, and he leaves a devastating path of destruction in his wake. His arrogance is beyond comprehension. I hope, I pray, he can be gotten out of office (by nonviolent means) before he does irreparable damage to this great country. He is a walking talking juggernaut of destruction.

If he was born on Mars, that would mean he's not even an Earthling. Of course, I have seen just as much evidence of a Martian birth, as I have for an African birth.
Yes, I have seen all the conjecture, hearsay, supposition and speculation about such an African birth, but I haven't seen a single piece of evidence, that is to say information that would be allowable under the Federal Rules of Evidence, supporting a non US birth.
As I said in a previous post, I'm not given to conjecture, fantasy or wild conspiracy theories. But, I'm not married to any particular dogma either. If someone has some compelling evidence with respect to Obama's foreign birth, let's see it. Absent that, the theories are the stuff of tin-foil conspiracies. This is why you haven't seen any of the well-respected conservative media outlets - and there are plenty - do anything but ridicule this "movement".
Again, show me something that is admissible in a court of law. So far, you haven't. All you have described is how other people cheat the system. That would be like a prosecutor bringing a burglary case against a defendant and only presenting evidence about how other people commit burglary. That won't fly.
As for "what is he hiding"? Who knows? And, who is to say he's hiding anything? Any competent attorney defending Obama from these suits would defend them the EXACT same way. Not a single attorney in the country (who wasn't committing malpractice) would acquiesce to these lawsuits.
There is PLENTY to be critical about Obama and his administration. Focus on those tangible problems and focus your energy in defeating Obama at the ballot box. This other mishegas isn't going to bear fruit.

Not one Politician or Congressperson has stated that they have seen his long form birth certificate. Don't you think it is reasonable for him to show it? (DOH weasel words mean nothing) There is no logical reason to let this question go on and on without showing it.
We Americans are not a court of law, an employee of the US should have to provide his documentation like anyone else prior to employment, or subsequently if the matter was overlooked. We don't need a court of law to investigate a person's eligibility to be President. It is up to him to prove it. Only liberals think like you do.
The DOJ is not investigating him, but protecting him (conflict of interest and violation of law by itself) I expect Obama to be treated like any other federal employee but he is not, he is given a free pass by those in charge but not by those of the public who question his eligibility.
I'll give you a hint, amended, delayed and short form Birth Certificates are big red flags for any background investigator, and to not investigate them would be malfeasance. Someone investigating a candidate or employee for any sensitive position in the US would have to verify an application and background questionnaire. I expect the same or better for the President of the United States.
The court of public opinion cannot be bought off with ridicule or deception, as much as people like you try. The truth whatever it is will come out. Do you want to know the truth? Can you handle the truth? Why is Obama fighting the truth? He is certainly not transparent and not unifying, the country, just more broken promises. There is no excuse for his conduct, no matter how hard you try and rationalize it or explain it away. His right to privacy concerning his eligibility disappeared when he ran for President and claimed to be eligible. We the people have a right and obligation to investigate and verify same, why is he fighting and why are people like you taking his side?

Hey, if I look around at the company I keep on this issue, I'm pretty comfortable - Ann Coulter, Mark Levin, Sean Hannity, the four conservative US Supreme Court Justices, the Federalist Society, The Thomas More Law Center, Judicial Watch. Are these the kind of people who are afraid of Barack Obama, are afraid of being critical of anyone or are unfamiliar with US law?
Like these people I value the law, and I put it above all else. I don't value the musing of internet bloggers positing the wildest conspiracy theories. I find it intellectually vacant.
I don't believe you value the law, and If you don't like the Internet musings of people who care to verify the meaning of the word is or if the President is eligible (without taking your biased word for it) then I suggest you go someplace else and communicate with like minded individuals who cannot think for themselves and discuss the law which we have seen Obama destroy.
