If he waits until July 3 or later to declare the seat vacant, he can APPOINT a replacement to fill out the rest of Byrd’s term.

And I’m betting the Dems will definately delay, delay, delay.

Regardless what we think of him, he surely had people in his life that loved him and they are mourning for him now.

Well, right now, West Virginia's coal country is being rocked by "Cap & Tax" with mass layoffs. The Rats will have a very hard time keeping control of Byrd's seat in the Senate if it goes to a special election in November. Even Rockefeller is under severe pressure.

Consequently, I guarantee that Rat lawyers will starting working today trying to figure out ways in which to circumvent West Virginia law.

Thus it will be interesting to watch the Demo-Rats at work as they try their damnedest to come up with some reason why his replacement can't be named until after the 3rd.

Considering that the 3rd is only 5 days away, that shouldn't be too difficult unless the financial reform vote depends upon it. Than we can expect a name by 5:00 p.m.

Amen. Didn't agree with his politics, but respect his years of service to our country. And he was always fun to listen to.

Here's the relevant statute:

§3-10-3. Vacancies in offices of state officials, United States senators and judges.

Any vacancy occurring in the office of secretary of state, auditor, treasurer, attorney general, commissioner of agriculture, United States senator, judge of the supreme court of appeals or in any office created or made elective to be filled by the voters of the entire state, judge of a circuit court or judge of a family court is filled by the governor of the state by appointment. If the unexpired term of a judge of the supreme court of appeals, a judge of the circuit court or judge of a family court is for less than two years or if the unexpired term of any other office named in this section is for a period of less than two years and six months, the appointment to fill the vacancy is for the unexpired term. If the unexpired term of any office is for a longer period than above specified, the appointment is until a successor to the office has timely filed a certificate of candidacy, has been nominated at the primary election next following such timely filing and has thereafter been elected and qualified to fill the unexpired term. Proclamation of any election to fill an unexpired term is made by the governor of the state and, in the case of an office to be filled by the voters of the entire state, must be published prior to the election as a Class II-0 legal advertisement in compliance with the provisions of article three, chapter fifty-nine of this code and the publication area for the publication is each county of the state. If the election is to fill a vacancy in the office of judge of a circuit court or judge of a family court, the proclamation must be published prior to the election as a Class II-0 legal advertisement in compliance with the provisions of article three, chapter fifty-nine of this code and the publication area for such publication is each county in the judicial or family court circuit.

He was sworn in on January 4, 2007, to his ninth term; the term will expire on January 3, 2013.
If the Governor names a replacement before July 3, 2010, then his replacement must go through the primary process and stand for election. If the Governor waits until after July 3, his successor finishes out the term.

Any guesses on how long it will take the Dem Governor to find a replacement?

That is not even a week away by government standards. I'd be surprised any Governor would be able to name a successor in that period of time. My family in WV absolutely loved Byrd. I mean really, really liked the guy. I actually hold little opinion on him either way other than like all multi-term politicians in Washington he needed to step aside.

Oh and RIP.

It's customary to say that, but, really, is there any "peace" down below? I don't know why we say RIP for those we know are headed the other way because in life they flaunted God's rules in His face. For someone who chose to serve himself -- before God and his country --I can't say RIP, but I refrain from being too cruel and factual about his life at a time of death. God has the best last word on this guy, and I am sure "peace" has nothing to do with the final judgment.
