Interior Secretary Ken Salazar said Tuesday he will issue a new order imposing a moratorium on deepwater drilling after a federal judge struck down the existing one.
Salazar said in a statement that the new order will contain additional information making clear why the six-month drilling pause was necessary in the wake of the Gulf oil spill. The judge in New Orleans who struck down the moratorium earlier in the day complained there wasn't enough justification for it.
Salazar pointed to indications of inadequate safety precautions by industry on deepwater wells. "Based on this ever-growing evidence, I will issue a new order in the coming days that eliminates any doubt that a moratorium is needed, appropriate, and within our authorities."

This means they know they will not get a stay on the judges order. This means they will get really slapped by the judge with a new order and perhaps a ruling of contempt of court

“Arbitrary & caprcious” has specific legal significance. It was the judge’s way of saying the admin’s position was so legally unsupportable as to be pretty much just a means of harassing the other side. IOW, BO had no legitmate argument.
It’s a signal for the next court. The arbitary/capricious language slams all doors shut for the next court up the food chain.
In essence, the judge said BO’s admin had no legal basis for anything they did. His side of the case was so weak, there was no good faith argument that could be made.
An appeal court could certainly view a case differntly than a trial court but when the trial judge uses the arbitary & capricious standard, the appeal should be one tough row to hoe.
If he does issue a new “moratorium, the Judge should throw him into jail for Contemt of Court.
And he knows how to make a profit.

You’re right. Based upon the statute and regulations, Salazar has no leg to stand on to issue a blanket moratorium. He would have to specifically prove the way in which each rig poses an imminent threat. He doesn’t have the facts to do so.
Has he got a valid Environmental Impact Statement including the impact on the economic environment?

Yes, and the governor has already publicly offered to let any and all govt inspectors on to the rigs for inspection.
The power grab was much too broad. Sort of like after a plane crash the president shuts down all air travel.

He can’t because his own inspectors have been to them and found no or only very minor violations. Besides, the judge will rightly see this as an effort to bypass the judiciary process.
