Hrm..islam convert?
Wouldnt be the first time....
Whats the difference between AWOL and desertion? I mean why would they change it.
The legal distinction is that you’re a deserter (dropped form the rolls) only after you’ve been AWOL for 30 days.
Don’t know now but many years ago I believe it was desertion if over 30 days.
>> Whats the difference between AWOL and desertion?
It’s a matter of degree.
AWOL: you’re voluntarily away from your assigned post in violation of your orders, but the perception is, it’s temporary and you’re coming back.
Desertion: you have abandoned your ordered position and all indications are you DON’T intend to EVER come back.
Desertion is a charge placed when it is determined or believed that the individual had NO intent to return - ever
AWOL is a mere absence without proper authorization, desertion is being absent with the intention of not returning. Desertion is a very serious charge, and if committed in time of war is punishable by death, otherwise punished as directed by a court-martial may direct up to Life at hard labor.
Ok, so what where his plans for getting on base. He knew he wasnt supposed to take firearms on base.
Exactly the way I remember it. Intentions is part of the charge.
A military base is an odd place to try to sneak into when you’re a military deserter. And “Christopher Paul Kilburn” and “Micah Noel Goodier” sure don’t sound like Muslims — obviously some US-born-and-bred whackjobs convert, but they usually change their names, and you’d think for sure when they have overtly Christian names like these guys do, they’d waste no time changing to Arab-Muslim names if they’d converted to Islam.
>> Ok, so what where his plans for getting on base.
Sorry, but understanding the secret motivations of brainless bozos is above my pay grade. :-)
They didn't change it, they're two separate and slightly different offenses with the distinction coming mainly from intent. If you leave with the intent of never coming back, you're going to get slapped with a desertion charge, Article 85. The RCM defines one of the elements necessary to prove desertion as, "..the intent to remain away permanently". That element isn't necessary to prove Article 86.
Maybe they converted but want to shed negative terrorist light on supposedly ‘christian’ or ‘non-muslim’ names so CAIR can point to them and say ‘everyone is doing it!’
Didn’t see that in the story.....
Desertion- (Knowingly leaving/refusing required legal military duty)
Other aspects may impact...
Depending upon the position /security clearance involved, some individuals will always bypass AWOL, and be automatically charged with desertion, in as little as 12 hours of unexplained absence.
We will probably have a long wait for the rest of this story, and may never find out the truth, but at least we know the Gate Guards at MacDill AFB are not slackers!
A soldier who leaves the base without authorization (even just temporarily) or who fails to return to the base at the end of an authorized leave is AWOL but not necessarily deserting. A soldier who leaves his post during combat, or while on duty, has deserted.
Pile on the charges.
