You’ll have to find me a jurisdiction in the United States where employers are not on the hook for what their employees do. It’s the law.
So if my employee goes home and murders his neighbor I go to prison for it? I don't think so.
The law does not hold the employer accountable for illegal activity at his place of business UNLESS he knows about it and does not stop it. Even something as simple as a sexual harassment case must prove that the employer knew the harassment was occurring
