That air pollution issue is just an interstate commerce canard. Air pollution can be sourced and “damages” can be handled in courts.
We’re better off with a slow, thoughtful, careful response through tort law than a single, all-powerful federal agency.
It's not worth most people's time to sue. Much less prove that they've exceeded legal discharge limits. You need government for that kind of operation. But never ever should you have any "all-powerful" federal agency. That would be unconstitutional.
