The real issue is whether Kagan has the same view of the Constitution as Obama or the Founders.

While she declined criticizing the Arizona law she did comment that she doesn't like the tone of the immigration debate because a certain group of immigrants are demonized. She compared the illegals 'demonization' (ie tone) to that of the Irish immigrants and others. She wasnt so concerned with the demonization of Arizona voters by Obama, democrats and the MSM though, just the illegals. Chapter 7 of her compassionate book:
Chapter 7 : Immigration reform : Because we all were illegal immigrants once
Chapter 8 : Compassionate conservatism, because conservatives are not compassionate like me
Chapter 9 : Same-sex marriage, because we need more love in the world.
