Kagan Called Dont Ask, Dont Tell A Moral Injustice of the First Order Tuesday, May 11, 2010 By Matt Cover, Staff Writer
(CNSNews.com) Solicitor General Elena Kagan, nominated by President Obama to replace retiring Supreme Court Justice John Paul Stevens, has called the militarys ban on homosexuals a profound wrong and a moral injustice of the first order.
Kagan made the comments while serving as dean of Harvard Law School during the 2005 controversy over whether Congress could withhold federal funding from universities that discriminate against the military. Kagan joined a friend-of-the-court brief opposing the government.
I abhor the militarys discriminatory recruitment policy, Kagan wrote in an email to Harvard Law students on October 6, 2003. This [policy] is a profound wrong a moral injustice of the first order. And it is a wrong that tears at the fabric of our own community, because some of our members cannot, while others can, devote their professional careers to their country.
The discriminatory policy Kagan opposes is a federal law, passed in 1993, that directs Congress to use its constitutional authority to make rules for the government and regulation of the land and naval forces to prohibit homosexuals from serving in the military.
Schools such as Harvard traditionally have used their non-discrimination policies to keep military recruiters off their campuses or, in the case of Harvard Law, to deny them the same official assistance given to other non-military recruiters.
In 2002, the Department of Defense decided to withhold federal funding from any university that denied official assistance to military recruiters.

“Don’t ask, don’t tell” was Clinton’s way of saving face on trying to get gays into the military, to make it look like he did something about opening the military to gays, and the effort turned out to be wildly unpopular.
The only real difference was that recruits are no longer asked if they are gay, so they can join. But if they act on it, they can still be kicked out.
According to the liberal rewrite, however, the military was wide open to gays and gay behavior, until “don’t ask, don’t tell” came along.
She also complained about the Moral Majority avenging innocent life. It wasn’t a compliment either.
Wonder how this non-judge will rule on gay marriage when she’s a Justice..........

Sex is part of it, but the broader issue is the legitimization of social/reproductive failure.
Inability to identify, attract, and mate with reproductively viable members of the same species has consequences.... and homosexual activists would like all of us to share in those consequences and call their dysfunction “Normal”.
The behaviors advocated by homosexual activism are no more “normal” than cancer is - and the historical record is clear that they are just as destructive to the social and biological fitness of societies that get lured into “normalizing” their abomination of nature.
